I tried to make sure that setting was checked.
    Please try one more time?

I wonder if they will present this BS to the GA Dept. of Labor when my unemployment claim gets heard?

    I appreciate that.
I was employed 5 years with NO disciplinary action whatsoever.
    No accident, tickets, or citations.
    Was I the best employee?
Of course not, but I was darn decent. LOL

They are posing this fine of cell phone use I know.
I have not heard of others yet!

I mean a reflection of turning off a light with a button on the side.
I might could understand if I had the phone in my hand?
    NO!
And, drivers do not want to work there with the pay.
Sorry, but they don't stay for long unless they can live off that amount.

    I didn't think of that.

    See paragraph 4:
"While operating a vehicle on work time, the Company requires that the driver's personal cell phone / mobile device be turned off."

So, I can use my hands-free head set to make a call while my phone is turned off. LOL
    Read further down-
Before using a personal device for work related purposes, you must obtain written authorization from managers/supervisors, human resources.
    NO ONE DID THAT!

    And continue reading:
The use of personal devices is limited to certain employees.

    WTH?

No, I totally understand your comment.
Yes, I do have a clean driving record.
I would not lie about that. Plus, I do want to be honest so that others would have the correct and truthful information.
If you have any doubts or questions, please ask.
I don't trust others myself, so I understand.

No, this is not equally disclosed.
Something is wrong here, but I am not sure how to proceed.
I am contacting attorneys and filing my unemployment benefits.
I will file anything necessary, but having legal representation takes this to an entirely different level.
I am very honest with attorney's as well. I don't want them not knowing the truth either.
Did I touch the phone. Yes, I touched it, but the company is exaggerating.
I will not give up seeking answers, because this does not feel legal.

Don't get it. Phone is in cup holder and you pressed one finger on it? Are you allowed to say change the radio station with 1 finger?
Turn on the AC, heat, turn on the headlights use a CB radio? All seams the same to me

    You can touch radio.
So-called "company policy" does not allow to touch cell phone. PERIOD. Hands-free.
Even GA law allows answering phone with 1 finger/touch.
    I understand what you mean.
We cannot touch that darn evil cell phone.

    I found this online:
Is it Legal to Dock Pay for Poor Performance or for Mistakes?
Generally, no an employer cannot engage in docking pay or fining employees for poor performance or mistakes, shortages, or damages. However, if the employee agreed in writing that a deduction could be made, the employer may be able to do so.

Only when an employer has reason to believe that the employee was responsible for the mistake and the employee agrees in writing that they will pay for the mistake can it be deducted from their pay.

Put the info on the open forum so other drivers in a similar situation may benefit.
