My guess is you would have to prove it, which means UPS cooperation. I doubt that will happen as UPS doesn't want to get sued also.

They have better things to do than get involved in someone's lawsuit.

This is the majority of it. I just left out the back and forth I went through just to get hometime in the first place and that I'm an idiot whose bad with names so I can't remember my dms full name. I've contacted the company and hr boiled it down to you weren't on the truck when load was delivered = load abandonment. I'm a bit poor for a lawyer but if I can find someone who will take it no $ upfront I would start the process. Anyway, I actually got a company that asked me about it and listened to my explanation so this might not be a problem anymore.

Do you have proof of this, like a series of text messages?

If so, contact an attorney and then file a complaint with your state's labor board.

Update. I lawyered up and managed a mediation that got the bad marks removed from my csa and pulse. I managed to get a good job practically equal to the one I missed out on for all of this. I passed on heavy litigation and settled with a cease and desist type order practically making it to where all they can say about me is that I worked there and was let go. Thank you guys for your advice!

Well done! Did you at least get Covenant to pay for your lawyer?

Along with this I would have pushed for. “ worked here and was wrongfully terminated due to miscommunication on the companies behalf”

Yeah I got a small settlement that pretty much just covered what I spent on the litigation process. I might have been able to get more but I really just wanted to get back to work and didn't have the time or energy for anything lengthy.

    Stringb8n and PaulMinternational Thank this.

Sorry, but it's not. They can hire or fire you for any reason or no reason at all. Employment is at will, meaning your will and the will of your employer. As long as they don't fire you for being white, black, hispanic, old or Muslim you got no case.
