Work Comp Claim Denied....

    Found out today that my back injury claim i filed back in late June was denied. The 3rd party arbitrator said it wasnt work related. How is it not work related, when i'm under dispatch, and climbing into the truck?? Spoke to a couple of people from the 3rd party investigation, and the last one told me, "oh we'll get the medical records from your hospitals", then find out they never bothered to get them. So guess i'll be making a few phone calls tomorrow, and if i dont get the word by the end of the day that they are covering it, the next call i make will be to my lawyer. Insurance only paid so much, but i've got about $800 in medical bills.

    oh..and i'm still waiting for a $90 lumper i paid cash for back in Nov. go figure....

    i've decided i'm going to pay the medical cost just so it dont end up going to collections and becoming a ding on my credit. But, yeah, they'll incure the cost of the lawyer as well.

    NEVER EVER pay cash for anything as a company driver. If it's need for the truck or job, get a comcheck.

    got in a hurry, and twisted wrong climbing into the truck. I was using the "proper 3 pt stance" and everything. Just pulled without pushing with my feet or something. Just got in a hurry, and it cost me.

    as far as paying cash...this has been the only time it has ever been an issue to get reimbursed. Their excuse is "oh well we reimbursed you on 12/08/2009"....well they DID....but they also deducted it on the same check. so -90 + 90 + -90 is still -90. Obvious someone in payroll dont know how to do general math. But from then on, i've paid lumper by comcheck.

    Keep telling the medical facility it is workmens comp. and then forward to the employer while this is going on.

    It cannot go to collections against you.

    The attorney would probably advise the same.

    I just paid the big bill anyway. Asked the lady about the claim, and how i'm appealing the denial, what happens. She said the company will pay the bill, then the hospital will reimburse me. lets see if that happens. But good info, Roadmedic...thx.

    Notice to everyone.
    Steps to file workman's comp claim.
    1. Report to immediate supervision.
    2. Report to closest medical facility.
    3. retain lawyer and speak to NO ONE without his presence.
