First of all my driver had enough time to get across the border into Canada and pull over and yes depending on how long it takes to cross he would have violated the 14 hour rule. There was another driver waiting at home in Erie waiting for the truck to cross. This driver would deliver the road. The driver crossing the border lives in Niagara Falls.
The driver still had over 1 hour on his 11 however the shipper took way to long to load him. He could have lied on his log book and showed that he arrived and got loaded within 1 hour however he wrote down that he got loaded in 4 hours.
Having said that I don't know anybody on this board who could honestly tell me that when you are 15 to 30 minutes away from your own home you would shut the truck down and take your 10.
I'm not asking for sympothy from anyone, I'm just explaining what transpired.
DOT/MTO why are they not held accountable for their mistakes?

The bottom line is the DOT officer knew when he pulled the driver over he had only about 20 minutes left on his 14 hour rule. After 10 minutes he let him go with no fines or warnings not even a written report.
My driver was about 2 miles form the Canadian/USA border when the same DOT officer pulled him over again. The reason he pulled him is by now he was over his 14 hour rule, the officer knew this. In my books that was a dirty trick.
The other problem is that we are at the Canadian/USA border and there are those people that do not like Ontario plated trucks. They believe we are taking away work from USA citizen and we have no right being there. -
I'm a small fleet owner and I do the best I can to ensure that all of my equipment and drivers meet rules and regulations.
Have my drivers broken rules in the past? Yes they have. Will they brake rules in the future? I'm sure they will. However it's by how much they brake the rule(s). I had drivers go over the 11 or 14 hour rule by as much as 30 minutes.
In todays economy you have to get unloaded and reloaded as fast as possible. We dont have the luxury to wait between loads. Today we work twice as hard to make half the money we did 2 years ago and we get harrased by the law 3 times as much.
Am I going to argue with a driver that is 15 minutes from home by telling him to take his 10. I don't think any owner would. -

We gave him enough time to get the load delivered to our yard where another driver would take it in. However they took 4 hours to load which brought us very close to the 14 hour rule. After he got loaded he proceeded down the highway. Four hours later he called us and informed me that he can make it to the border however he could not make it to our yard since he will be over his 14 hour rule. We then called a relief driver to wait for him at the border and take the load to its destination.
Having said that we did everything possible to be within the rules however we knew that it was cutting it close. -
The driver still had 10 minutes to go before he would run out of hours. The DOT followed him until his hours expired and pulled him over again. This time for violating the 14 hour rule.
This was a setup by the DOT officer period. People like that should not hold the position they do. -
So then you're saying the driver didn't have enough sense to know that he needed to shut down and that somehow it's the cops fault for not telling a full grown man how to do his job?
The cop probably knew the idiot would just keep running and figured he'd put him to the integrity test!
The driver failed that test with flying colors! Then YOU come here and try to defend the actions that the driver took and turn it around and attempt to lay the blame on the cop?
If I was the cop, I would have done the same thing...The only difference is, I would have written the guy up and not let him go!
You ought to be kissin' that cops butt for cuttin' your driver some real slack!
That could be said about some small fleet owners too it seems! -

The DOT officer gave him slack because he knew that if a ticket was issued I would fight the ticket and I'm sure it would have been brought up that the DOT Officer set up my driver.
I don't take any bull from anyone I have started to fight any ticket that I think is unjust.
The driver was 2 miles from the border when he got pulled over and you can honestly say that it's fair.Kiss his butt yeah right.

But common! 2 miles from the border. He wasn't over by 30 minutes or more he was over by 5min.
