Need dot consultant? Dot advice

    thank you! my question is, if the shipper has less than 1000 lbs of Hazmat along with rest of freight, no placards needed, do we need Hazmat on or license, or is it ok to go with it? our driver manager AND the shipper both said "oh, it's OK" but we were scared to death we'd get pulled in (my hubby and I team) and get a major ticket. were we right to worry or is it really ok as long as it's less than 1000 lbs?

    The only thing the 1000 #'s is for is whether it has to be placarded or not. You have to have the hazmat endorsment to haul it period! You are lucky you didn't get caught. :biggrin_25521:

    dear retired,
    I was wondering how/if a former driver of a company could get DOT to compare qualcolm and logbooks. I am willing to bet neither would match on 50% or more of drivers.

    Not sure it would help but if you could take a short video of parking area you just left to show as evidence to whomever stops you enrouote to your next spot - it might help. I would expect every driver to have a digital camera with them these days to record incidents of all sorts.

    Not a driver (yet) but I do find reading this site very ineteresting. I start CDL class next week.

    But, the company is only required to retain the logs for 6 months.

    If placarding is required, an endorsement is also required. If placarding is not required, neither is an endorsement.

    Depending on what the 1000 lbs of haz mat was, it may or may not have required placarding depending on what placard table the material is included in. Table 1 haz mat must be placarded in any quantity and therefore an endorsement is required. Placard table 2 materials do not require placarding if 1000 lbs or less and therefore no endorsement is required, but an endorsement is required at 1001 lbs or more.

    If I'm in the middle of my federally mandated 10 hr rest period, can an officer "make" me come out of the sleeper? Example: I pull into a rest area and go to bed. The rest area has a sign that says, "no over night parking" and an officer comes through to clear the rest area. He knocks on the door and tells me to step out of the vehicle. Can I refuse to come out of the sleeper and have this federal law to use as a defence when I get the ticket?

    This is true. IF THE HM BOX IS CHECKED (or has an X in it), even though it may be a "limited quantity" or less than the placarded quantity, with that column marked, YOU MUST HAVE A HAZ-MAT ENDORSMENT.

    This is one of those laws that is seldom enforced during an inspection but if you have an accident, you can bet it will be.
