okay, I'm gonna use your car in a responsible for the next year. In that year of being responsible, I'm gonna take a corner too tight and destroy a tire/wheel on the curb...send the bill to your insurance. Few months later, I'm gonna pull into a parking space and scrape the &^($ out of your bumper and the car next to you....send the bill to your insurance. Few months after that, still being a responsible driver, I'm going to sideswipe a pole because I slid on ice on the shady side of a building, $2,500 in damage........turn it over to your insurance.
Now, it's 4 months later and your insurance comes up for renewal, you've filed $4,000 in damage claims in the last 12 months. Your insurance company presents you with a 25% premium increase, do you suck it up and pay it, after all, it's just P&L or do you go elsewhere. BTW, fi you say you go elsewhere, all those accident claims show up on a CLUE report the insurance company is going to pull, the new company will charge you a premium for those accidents, plus the change in companies.
Now, here's what the intelligent person does, they tell their friend, your paying for the damage (maybe your nice and tell them you'll split it with them) instead of getting hammered by the insurance. If hte friend refuses, well, it's time to end the friendship and take them to small claims court for the damage.
BTW, if my company turned every damage claim into the insurance, I seriously doubt I'd be making $56,000 a year, I'd probably be lucky to make $50,000 a year because their increased costs. BTW, all these drivers who say "let the company pay for it", when you carrier fires you, they will report the accident to your DAC report. What does that say to your next carrier?

this is one of the reasons this industry is so screwed up--the yes i will work for low wage--yes of course if i have an accident i will pay for the damages---
whats next--if you dont consistently hit 6.5 mpg you pay the difference??

i agree completely and i ran canada alot when i was with swift and i had to abide by there rules and no differnt for them when they come to the states...
and with any company i have worked for if a trailer was not (road worthy) it won't move hooked to my truck and that is that and i have to say swift was the best about this but just make up your mind and make it happen

A hard lesson learned early in my career is: When two laws, standards, rules conflict then you MUST default to the more stringent rule.
Driver should have known Canadian customs / laws before trying to cross. Driver should have refused equipment with spring damage period and notified carrier.
Driver should pay ...... if he told carrier about spring, 50% if not 100%.
I've said it before..... we have to grow up and put our big boy pants on. This equipment should not have left yard no matter the penalty. ( short check, job loss etc) It has to be that way ! Let the carrier whine and threaten you ! Give him a slice of cheese ( for his whine ) and a quarter to call so and so who will do it !

im glade that up here in here in vermont that is agenst the law. i know this becuse pepsi had to change thare rules up here for us. becuse it was if your missing soda you pay for it. but now thay can't do it anymore becuse vermont changed some laws. so up here No one can tuch your pay check for anything.. i really like that
