I feel the need to add something to this thread...
I have been home since the 19th, sustained a back injury (pulled muscle) while training in the ARNG. Dr. put me on pain killers and muscle relaxers,,,,TMC won't let me back to work until I get Dr release, which means going back to the Dr. Which means waiting on the state to set up my appointment...
So, that is where I am at this point..enjoying time with family.

Well it just keeps getting better and better....
Just got a call from FM and now am terminated from my employment with TMC...
I guess once I get healed up they will take me back...LOL I am sure they will, so not worried about that. Or, maybe they wont, for whatever reason. I do not have any ill feelings toward my FM, he was a good FM to me for the short period I worked under him. I also do not have any ill feelings towards TMC in general, love the way they keep you busy and I have no complaints. Just not sure how to take me being terminated, how will that look to another company? How will it be worded on my DAC? If anyone has gone thru this, fill me in please...

Am I understanding you to say: that you were injured while serving our country in the Army Nat'l Guard, and that TMC has fired you because you can't return to work, due to the injury you received while doing ANG duties? Have you kept TMC updated about your medical status?
I do not know how this will be worded on your DAC, but a "termination" would not be viewed in a positive way by prospective employers. I think you should call TMC and speak w/your dispatcher and/or dispatchers supervisor, in a effort to have this changed.

I was told that, because I did not drive for them, for one year, that I do not qualify for the "family wellfare act" of some sourt....

The more I think about it the more I scratch my head...LOL
I am going to try and get Unemployment Monday, if I can than that will be the positive, out of getting Terminated and what not. At least then I can start drawing some money. Right now, that is not happening.... -
under the law you have to work for the company for a year or more. What I dont get is did you get fired because you could not work or did not report for work ?

Why is the state setting up the DR appointment? If the Dr did not release you then they can not fire you unless you did not let them know you were hurt. Plus way aren't you on disability? -

I have kept my FM up to date on everything and no, I did not get released from the Dr. I have 12 visits of Physical Therapy to do yet and than he will give me a 100%
I am not on disability and am not drawing any money. The military won't give me any money for about another 3.5 wks -
Check with you unit as well. There are laws in place that protect weekend warriors. The ARNG maybe responsible for paying you until you are fit for full duty. As well as your employer may not be able to terminate you while you are on active duty. By my way of thinking if you are not fit for full duty due to an injury that occured while serving that you are still on active duty until that time.
