You can't physically buy something from your sleeper unless you're getting it delivered. So what they're going to do is ask you you where you spent your time, you'll answer in the sleeper, then you'll get the overly dramatic head tilt and confused look with the question how did you buy something inside the truck stop when you were in the the sleeper?, you'll say something awesome like who cares I was still at the truck stop, then they'll say who cares? who cares? my client cares, oh wait he's dead, so I guess his family will have to care, oh wait they're dead too....that's you cares. Then he'll crumple up a piece a paper and throw it you and leave. That old lady on the jury is in tears, the middle age guy can't believe you just said who cares during court, the single mother of three doesn't care because she just wants the freakin trial over so she's gonna go with the flow. Then someone in audience starts a slow clap as the prosecution storms out of the court room.
This is how I see it playing out in court, I should probably get some sleep.
on duty not driving after 14

your quite the drama king there, aren't you.
sorry about your luck. but i don't see it being played out like that.
but you see, it's also like this. i don't drive with a box. which means chances of me hitting someone becuase i'm tired is virtually NILL.
becuase if i'm tired. i take a nap. i don't wait till the box says i'm done for the day.
but i guess. according to how your day works. you drive. and you sleep. and that's all you do. i guess you never eat, or shower or anything else becuase you confined yourself to the sleeper.
does it make a difference if i take my 2 OFF DUTY TO BUY SOMETHING then claim the 8 sleeper. would that make you feel better in court.
do you REALLY think that no one gets out of there sleeper at some point and time to walk inside the doors. or are you one of them UNREALISTIC THINKERS that thinks EVERYONE crawls in the sleeper that what's where they stay. till it's time to jump back in the seat again. JUST IN CASE SOMEONE MIGHT HIT THEM.
like i said. i'm wehre i'm supposed to be. doing what i do ON MY TIME. cuz i'm OFF DUTY OR SLEEPER BIRTH. makes no difference. I'M OFF THE CLOCK. RIGHT WHERE I'M SUPPOSED TO BE.
if someone gets killed it won't be becuase i was tired driving according the box and ran into someone. it's because i took my break. now i'm on the road right when i'm supposed to be. and they ran into me.
but i guess you'd know that becuase your a 4 wheeler and not a trucker. and statistics show that 85 percent of all accidents are caused by the 4 wheelers.
doesn't matter what i do with my off duty time. i'm right where i'm supposed to be. and there isn't anything any lawyer can do.Last edited: Jul 8, 2012

so your saying it's perfectly legal to flip flop and 8 and 2.
but it's not legal walk out of the sleeper and make a purchase.
you're in fantasy land. 4 wheeler. -
People are getting very confused here.
You can use any combination of sleeper and off duty to reach your 10 hours off duty. The 8/2 split is a totally different animal and was not part of the question.
You can show your 10 hour break as 10 off duty, or 10 sleeper, or any mix of the 2. Nothing says that 8 hours of your break must be in the sleeper. The 8 hours only applies if you are using a split.airforcetoo, scottied67, Autocar and 1 other person Thank this. -
And yes I think you can flip flop your 8's and 2's.
