Why am I getting a bunch of #### over this? Read the #### rules, it's right on the front page.
PROVISION: Penalties
PRIOR RULE: "Egregious" hours of service violations not specifically defined.
FINAL RULE - COMPLIANCE DATE FEBRUARY 27, 2012: Driving (or allowing a driver to drive) 3 or more hours beyond the driving-time limit may be considered an egregious violation and subject to the maximum civil penalties. Also applies to passenger-carrying drivers.

And guess what the maximum civil penalties are? Exactly what I said they are.

This was over his boss that got hit with $17k in fines for 40 violations at once. That really sounds like someone that they would take the opportunity to make an example of. And like I said in the post, "they could hit you with" this new much higher rule. You disputed that, I pointed out the rule. -
To DOT Consultant,
Thank you for your assistance.
We are an owner but not an operator. We have a driver who will be driving our truck in the oil fields. We have our own Authority, however, the carrier we will be working for told us we will be running under his Authority, and we will be using his DOT# and MC#. We are required to get Bobtail insurance with his operation. If we run under his Authority, can we keep our Authority/MC#/DOT#? The carrier had DOT inspect his operation and they approved everything. Another reliable source told us we have to relinquish our Authority and MC# if we are going to be under the carrier's Authority.
Thanks! -
You can keep your own authority, read the fine print in the contract so you know what responsibilities each party has.

Compliance Guy,
Thank you very much for the information. I appreciate your reply. -
I had my own authority years ago. Closed the doors in 2006. Can I resurrect or reinstate my old numbers or do I need to start fresh?
I closed the company down clean, it was not a forced closure by any outside entity, governmental or otherwise.
