I'm an independent contractor for an OTR company. I'm currently sitting because I'm a couple of days late on getting my logs turned into our safety and compliance dept. Although they are in the hands of the mail system at this time, its is only a matter of time. So until then the company will not dispatch me. This I fully understand and comprehend. But they have also threatened to hold my paycheck until the logs are received and processed. My question would be: Is it legal for a company to withhold pay for late logs?

Not sure but probably get by with it that's trucking for you I would look at your contract to as 123456 stated just my opinion.

safety is big issue with most carriers these days

One good thing about e-logs never have to mail mine or anything now if I can only remember to go off duty be all good

now that you are aware of this, the logs will probably be sent in sooner next time, this about standard procedure and a good hammer to hold over a drivers head to send in logs.
moral of the story , send in the logs and this wont be a problem
when i had several drivers leased, i could ask and ask for logs, and would be told i will get em out tommorrow. lol
when i wouldnt load an advance or cut off the fuel card, i would by some miracle gt a ups or fedex tracking number, of the fax would ring.
it was truly amazing what a coincidence that was.
when you lease on , every company expects logs and paperwork to be sent in regularly. if you dont hold up your end, they may not hold up theirs. -
I know if you were an employee it would be illegal to withhold your pay but don't know about a contractor . When I was leased to Bennett I had a problem with getting the logs being turned in to the terminal on time but they failed to send them to corporate . Corporate gave me a fax number to send copies directly to them . I'd never trust the USPS . Try to get a fax number

If carriers didn't impose such requirements, they'd be behind with a 1/4 of their drivers. There are laws the carrier must abide by, and non-current logs is a huge problem for those who don't "provide an incentive".

If the carrier gets audited there could be major fines if they don't have all the drivers logs. If you send in your logs along with all the paperwork on each load it will be a non issue.
