oversize partial ?

    If you file name the shipper as only defendant named and list the rest as defendants unknown now but to be named later.
    That way you'll put a wedge between the shipper and ATS and anyone else that may pop up later.
    If remember correctly ats does have an exclusive use part on rate sheet. But is it on main sheet or subsequent ones?
    Plus the shipper chose to load you after knowing that you had something on your trailer and gave their ok by the act of loading you.
    Shipper could've sent you on without loading you. This is another reason I don't fool with LTL crap and ATS has had real cheap rates on anything I get privy to. I would choose where I file suit carefully and include a provision in my complaint wanting to bar defendants from Blackballing to.
    This isn't legal advice just how I'd do it myself if the need arose. I'm still looking for my million.

    I got a blast email from sureaway wanting to pay 4.00 a mile for a 14ft wide and you bought permits and escorts out of that. Od rates have sucked for 2-3 years now my signs haven't seen daylight but once in the last year.

    it says exlusive use right on the ratesheet, I can't argue that, my bad ! What I am arguing is me voiding the contract doesn't mean they get to just pay me whatever they want. Thanks to Mr. Grumpy Shipper everyone knew about it before the load was loaded.

    I'm gonna say, hey, if it's time to renegotiate the price I'm going higher. I thought my permits were gonna be about $200 and they were $311. I thought it was box shaped and a one hour tarp job. Now that I know it's a 3 hour tarp job that adds $160 as well. Now that I'm thinking about it, I think the last time I tried to book a load with ATS they called and cancelled as I was on the way to pick it up. I never bothered with a TONU, but since I'm suing them anyways might as well get my $250 for that as well.

    To be honest it's not even about the $800 now, although that was outrageous. It's that they thought I'd just bend over and take it. Is it because I'm an owner/op ? Is it because I have a newer MC# ?

    I have ran "exclusive use" loads before, but the load also paid accordingly. In fact, one was a single box that paid me $8 mile from IN to WI, and it fit in my 24x24 sidebox. But hey, they paid for the use of my truck.

    Exclusive use is a joke, who the hell is anyone to tell us what we can do with our trucks? Thats like telling a mechanic after he gets done working on our truck to lock the tools he used on it up and that he can't use them on anyone else's truck.
