Got inspected today,.. didnt think I had anything to worry about. I do paper logs and make sure everything is as they need to be.
Anyway,... He comes back and says I have a 30 min break violation on the 18th.
I logged .25 for my PTI, driving for 2hr, then show .25 for fuel and then .5 for my break. He had no issue with any of that. How ever I logged 8 more hours of driving. He says I needed to take another 30 min break.
I thought the rule was you only need to show one 30 min break within your first 8 hours of driving??? He says I need to break 30 min for EVERY 8 hours of driving. I cant find where it says that. Is he right or did I just get bull horned?

You can't drive past the 8th hour coming on duty without taking a break of at least 30 mins. Best to take your break between the 5-6 hr IMO. Sometimes you could get stuck taking to breaks otherwise.
As long as you only drove 8 hrs you should have been legal, as long as you didn't log on duty after coming off the 30 min break. So if you took the 30 min break and drove 8 hrs, and stopped you were legal.

The way our company explained it to us (and we are on paper logs as well) If you take your 30 before your 6th hour on-duty (either driving or not driving) you will end up having to take a break again. If you take the break between your 6th and 8th on-duty hour (driving or not driving) you are good until you run out of time.

Once you drop to line 3 or 4 from your 10 hour break the 8 hour rule takes affect. This 8 hour rule only will stop once you take 30 minutes on line 1 or 2.
If you take a 30 min break and go back to line 3 or 4, the 8 hour clock starts again.

I shouldnt be FORCED to break if I dont want to.
I miss the good ole days when DOT was more worried about your tires and brakes,.. they would give you a hard time for a peanut light out on your trailer too.

They are really interested in the 30 minute break and the 34 hour restart.
Remember, it is all about safety.......... -
But how do they know you were actually taking a break? You could of went off-duty not driving 30-min break at the customer but you were unloading the trailer. These 30 minute breaks suck. Some drivers might be tempted to drive almost the whole 8 hours and then take a break especially when a trip is 6-8 hours long.
