10 meter radio in a truck - legal question.

    Gadfly, is this certification number known as anything else? Want to make sure I'm on the same page with Ranger, when I call them in the morning.

    I had a Pace 2300 back then also. It was great radio. I guess one, if not the best, radio I ever had. It was made by Browning (Eagle) if I remember right. Only had 23 channels. It had a channel knob, a volume & a squelch knob. Oh it did have a power meter.

    Mine was great too. Drilled a hole in cab of truck roof exactly in center. Mounted Hustler base mount antenna and some decent coax. Out talked all my buds and co workers by a mile. Simple and effective. Too bad life can't always be so easy.

    Been reading all those cases where the FCC cracked down on some CB'er for having way to much power and bleeding all over the band. Its all a bunch of bull pucky. First off in every case the FCC goes and sees the " suspects" at least three times and whacks em on the willy tells em dont ever do it again.
    It isnt till the 4th time that they show up that you start seeing those 10,000 dollar fines. If you ask me so long as you stay in the CB band dont ever roam out of it even to listen you will be fine.

    First the radio only has 6 Bands and won't go above 28.305. So how is it a Ham radio. 28.000-28.300 is CW only which this does not have. And your RCI-2970 is not FCC approved either. So yes someone lied.

    Wingnut, WHERE HAVE YOU BEEN? Bill Clinton signed that into LAW. ALL STATES CAN ENFORCE THIS. And Maryland uses it to make money. Maryland has been doing this for several years. A truck crosses the scales and DOT looks into the truck. They see a 10 meter/Export/Amateur radio. Then they ask if you have a license to operate that radio. If you do have one it will cost you a $7,500 fine and up. This is what made me get my Ham ticket.

    Ehlers says that when he was contacted initially by a frustrated constituent who had been experiencing TV, radio and cordless telephone interference, he thought the problem was an isolated incident. The CBer in question was using an illegal 100-W amplifier, he said, and the FCC told his constituent that it did not have the personnel to enforce CB lawbreakers around the country. Ehlers says he introduced his bill as a result.
    As did Feingold before him, Ehlers asked the ARRL to review his measure to ensure that it would not unintentionally harm Amateur Radio.
    The bill was amended in the Senate, which made a specific change requested by the American Trucking Association. The final version contains language with respect to CB gear aboard a "commercial motor vehicle" (as defined in Title 49, §31101 of the US Code) requiring that state or local authorities have probable cause that the vehicle or its operator was in violation of the regulations before they attempt to enforce such a statute. On the House floor, Ehlers said truckers were "worried about perhaps being harassed by improper use of the law."
    During discussion of the bill on the House floor--as reported in The Federal Register--one member spoke of "rogue operators" whose routine CB radio operation at excessive power levels left victims "helpless" to defend themselves. "When these operators boost their CB power levels, it often causes bleeding into nearby frequencies," the congressman said.
    The bill passed the House under suspension in September, and passed the Senate at the end of October under unanimous consent. The measure went to President Clinton for his signature on November 14.

    This has been argued ad infinitum for years. Users of these radios try to legitimize them with all sorts of assertions, and, of course, they would: After all, such users have a vested interest in such use. One is to be able to use higher power than allowed. The second reason is to get onto unauthorized frequencies that CBers often think are "empty". Then there's the "king of the hill" syndrome where one operator wants to feel that he has the best signal going, etc, or a "better" radio than the next guy. There are also other reasons CBers use to justify their use.

    These so-called "10 Meter 'amateur'" radios have certain characteristics in common. First of all, there's usually a "channel" selector that goes from 1 thru 40, indicating that it will be used on the 40 CB channels. Then there's a "band" selector with bands A thru E. or thereabouts. What is this for? It indicates, on its face, an illegal and common in the CB world penchant for "extree" channels such users have no right to. While most CB ops don't stray outside the actual CB band, for some the temptation is just too great. They feel they are somehow "special" and have no need to have authority to interfere with the operations of LEGITIMATE licensed stations, OR, thru simple ignorance, they have been taught by CB legend and lore that "them channels ain't used no more", so we can use 'em for our "trucker's channel" , or "private" channel. It just ain't so no matter how much people try to justify their use.

    Such radios, called "10 Meter 'amateur' radios" with the "band" switch (for extra channels), and CB displays are not fooling anybody, least of all FCC. If one were to CALL FCC and ask about a particular radio, either by physical description OR a certification #, you will almost certainly come back with the word "ILLEGAL", no matter HOW much one tries to justify such radios. Their whole existence was/is to attempt to skirt the law. Period. What IS significant is, if you get CAUGHT USING such a radio, you WILL be cited, warned, or FINED for 1) use of an uncertified radio, (2 Use of frequencies without a licence, either amateur or otherwise, or BOTH!! The word "uncertified" or "use of" shows up quite often in the FCC citations that come up on their Enforcement page.

    One would be correct to say that far too many CB violations go un-caught due to the FCC budget, but people DO get cited or warned---even FINED----for it on a regular basis! Some of it IS due to the fact that the people licensed for the 10 Meter band get really upset about finding somebody a-'10-4-ing' with a echo or a beep-squeek, and they go out and FIND the offenders. They are quite good at DFing--even mobiles (truckers, too) and they make strident protests to FCC over it.

    Now with all that said, If you are determined to USE such a radio, then if you STAY ON the 40 CB channels, you are unlikely to get into trouble. Really, no one cares--until you splatter all over the place, OR start talking on "your special trucker's channel" (that happens to belong to the actual 10 Meter band!).

    Not true. It is illegal to use a transmitter that works on the CB bands (and is not certificated for CB), unless you have a license for a service where that transmitter DOES work. The FCC "presumes" that you are using it if it's in a readily useable state. (Hooked up on the dash is; in a box under the bunk isn't.) This presumption has been tested repeatedly in court, and it's held up.

    I have a ham HF rig in my truck. It originally did NOT transmit on the CB band, but when I modified it (legal for hams to do) to allow use on the new 60 meter band, it also enabled transmit on CB. Since I do have a ham license, it's absolutely legal for me to have it. And yes, memory channels 1-40 are set as you would expect.

    That said, if I'm heard working CB SSB, and my truck is checked, I'm in trouble... since my CB is AM only.

    There are people whose hobby is direction finding. One such ham I knew had a spectrum analyzer and a transmitter "fingerprinter", and he lived near a truck stop. Every now and then, when he'd hear an idiot running a "splatter box" nearby. he'd take a trip down to the truck stop and track it down. Once he did (took about five minutes), he'd park at a discreet distance and then key up on the idiot's channel, and say something like "Smith Transportation truck number 12345, I'm sure you're aware that you are operating an illegal radio".

    Silence inevitably followed.
