Tennessee ripping off drivers over Medical Cards....

    OK a little bit clearer, but let me ask a few other questions - just so I am following this right.

    So you didn't have to renew your license after 1/1/2012 but your dot physical expired after that date?

    Did you send in the self-certification stuff before the DOT physical expired?

    If not how would the state know that your dot physical expired in the first place if you didn't send it in and then how would they know that you had sent it in triggering your suspension?

    Now I am asking not to be dumb but asking them may help you take this up with others in the state, or possible the federal level. I think this entire program wasn't thought out well enough to protect US against different situations. one of which is this mess and the other is what I described in my situation. I think forcing the states to suspend the CDL privileges indefinitely when the Physical expires after a grace period of 90 days is right (except if the hazmat expires but that too we should not have to go through a background check and a test every time) and allow the CDL holder to get back his/her privilege by reinstating without the crap of going through the entire process but a nominal fee - say $25.

    That makes sense. But in my case, no one knew what to do with my dot physical forms and this if I remember right was in October of 2012.

    Not sure why they had to redo their Hazmat, I just went through this in NOV and I didn't have to renew my Hazmat. I had to goto Chattanooga DMV office, there are only 3 in the state: Nashville, Knoxville, and Chattanooga but, it will be closed by end of year,,,anyway, I went to Chattanooga and paid the re-reinstatement fee of $75, after faxing a copy of my med card, twice, to Nashville. Once that was done I was required to go to my local DMV to get my license renewed. I called before I went to verify I did NOT need to renew my Hazmat endorsement. We too were in the middle of moving so, had to wait for Electric bill to come in before I could renew my license. During the renewal I found out my wife's license was suspended as well, because her med card expired. She is no longer driving truck so, she just went back to a regular license so, she didn't have to renew her med card. It was a pita but, I got it done just like I said. Maybe when the OP went to renew their license the person behind the counter did not know about NOT having to renew Hazmat for this particular situation.

    Here is my question; is the suspension of a drivers license, because of not receiving their med card, a moving violation or what? I don't think it is but, having a problem finding it on the web to verify. I know my speeding ticket is a moving violation, that is what I was pulled over for but, I was pulled into the scale house and when I got on the scale, they pulled me around back and performed a level 1, which is when they discovered my license was suspended. I really am just looking for a simple definition of the difference between Moving and Non Moving violation.

    I would say the ticket received under the level 1 is a moving violation. You had to drive the truck in so it was a moving violation.

    I just downloaded the form.. filled it out and mailed in all the required info back in May ... no problems....

    On the citation itself, the "non-moving" box is checked and the "moving" box is not checked... but, I know you were guessing. The truck was not moving when they found out my license was suspended for this med card deal. It is also listed as non safety related offense. I was cited for 2 non-moving violations but, just for future reference, want to know the definition of a non moving vs a moving. Why this is so hard to find perplexes me... You would think it would have already been asked. hmmmm

    Almost same thing happened to my wife an I in Indiana. She faxed her paper work three times they never got it went to local BMV they faxed and never got it. Almost same with me. We had a heck of a time only way we resolved friend from motorcarrier took paperwork and hand carried it to the processing person.

    I looked that up but, it just states a driver with a CDL is not allowed to drive a CMV...vague as always..lol Probably because it is a new law that has not been updated in the book/s yet.
