CDL and DUI

    Settle an argument for me:

    I understand that in most states for the normal driver, the max BAC is .08%, and for a commercial driver, it is .04%

    Does the higher standard of .04 apply to a commercial driver, even if he is either operating a private (non commercial) vehicle, or just drunk in public?


    I am not a lawyer and do not play one on TV.

    .04 only counts when driving a commercial vehicle, .08 for a 4 wheeler

    i played that game once. got arrested with .005. that cop said .04 just for having a cdl. i was in my own vehicle so i was allowed .08.

    that was a few years back. i'm sure the laws have gotten tougher for us.

    the cop got fired not too long after. and i don't know how much faith i'd put in his answers. at that time.

    i'll tell you this, though. if you get busted in a CMV. your suspended for 1 year from driving a commercial vehicle. second time. your suspened from commercial for life.

    if you have a CDL its .04 dont matter if you are in the car or truck .04! is the MAX! a DUI will kill you if you don't kill someone else first...

    That is what I understood, I was talking with someone about this and he thought that the .08 was the limit for non commercial vehicles and public intoxication. I told him that for a CDL holder, the higher standard of .04 applied regardless of whether or not a commercial vehicle was involved. Based on that, best practice would be to get blitzed early in your 34 hour reset so you can sleep �� it off before returning to duty if you are so inclined. Lol
