    My attorney is looking for anyone who went through training and or worked for western express over the past three years. Justin Swidler stated to me in all of his years in law he's never seen a company screw over drivers as bad as western had.

    I have a feeling this thread is going to fill up fast. If there's merit to the case and eventually is ruled in favor of the plaintiffs, I'm willing to bet other companies are going to take notice....then again, maybe not.

    There's one against Western FLYER Express that I know of and the one in which Western Express has against Pilot/Flying J. This is the first I've heard about this one. Am I missing something?

    I went with western for the good deals on their website stating, be your own boss, walk away lease, no balloon payment, 2400 to 2700 miles a week or more. etc. I went with the lease program thinking I was gonna be a first time truck owner. The contract I had signed was to a 2011 Cascadia freightliner truck number 1590. b4 leaving out of the terminal and after inspecting the truck for defaults, I noticed the truck needed a service done which is consistent with greasing truck and fifth wheel, changing oil in motor and changing the filters, and looking over the truck. I had went into the shop and wrote the truck up on the night shift. The shop personal at the service desk declined and said it did need one. I have a 15 yr diesel mechanic back ground. I knew better, so I waited for day shift, when the morning came, I walked in and as the personal at the service desk to do a service on the truck, he had informed me it was a lil past due and it will get done. 3 days later the truck had broken down due to water in the fueling system. I had only found out that the shop didn't drain the water/fuel separator upon changing the fuel filter. So I sat at home for a week waiting to hear something back from western, Now I know that tryin to get thru too or waiting for anyone to call back, pft... would have better chances getting a camel to pass thru the eye of a needle. The truck was there for about 3 days for a service, a service should only take 1.5 to 2 hrs max. After being home for a week, I had gotten news do to a recovery on a truck in lucky, Oh. So i took a bus up there to pick the truck up, I was givin a 100.00 advance to take a cab too the truck. I never got reinburst for it, it was 40.00. Western had told me i could have the truck if i wanted it, after leaving, i had gotten 3 miles down the road and the dash board lit up like a christmas tree. Oil lite, shut down engine, and check engine lite. The truck was losing oil pressure. Western told me it us came out of a shop. ?.... really? I had informed western that i could carry on with the truck as long as i kept the RPM's up on the truck to keep the oil pressure up. So i headed to nashville. While heading to nashville i was informed that another frieghtliner was at the terminal with truck number 1390. I sat for 4 days waiting to get in the shop to have some things done on the truck 1390 after i had arrived. After waiting i had found out that truck 1390 was contracted under another driver that was on a recovery. Now my opinion there are rules, Dont mess wit a truckers load, dont threaten a trucker, keep things short and sweet, communicate, and you sure the hell dont drive another truckers truck unless he gives the go head... When i found that out, it struck a nerve. I told western, this truck is under contract with another driver and i was directed to take it, thats not gonna happen, how would you like some random person come walkin up to your mobile home, put his things in it then leave, while youre payin on it? Dont ever do that again, thats wrong. A list was given to me for trucks to pick, so i picked 11022 an international. The turbo was going out in it about 2.5 weeks ago, and needed a service. I had drove the truck for 2 weeks with out a problem untill i started hearing the bearrings going out in the turbo. I sat a week b4 the shop even looked at it. 2nd day there the shop said they had 27 trucks ahead of us, but only 6 in the lot, was there a week, only 1 or 2 came in, the following thrusday (the day i should have went in the shop) the shop closed early cus of a suppose Ice storm that was headed in, but never came, So i took pictures of the so called ice storm, the water on the ground wasn frozen. Friday rolled then around. The shop pulled my truck in and looked at the turbo, now i had informed the mechanic that i wanted to look to see what was going on b4 cleaning parts, or putting parts on, or replacing parts. Im buying the truck, i have a right to see things that are wrong. The shop agreed. But was a lie, the mechanics had pulled my truck outside and said the turbo was out, I got to looking while the hoses were still off the air to air, I ran my finger in the air to air and no oil was on my finger, that had me puzzled, even looking inside the air to air it was clean. They had cleaned the air to air out with out my knowledge or telling me the work that was done on the truck to inform me that they had done something, even tho knowing the answer, i had asked... if the turbo was out and spitting oil out, wouldn the air to air have oil in it aswell? The mechanic (Tryin to play me dumb or didn know what he was saying).. said, Not nessasarraly, I said... it would have to pass thru the air to air to get the tube on the other side soaked in oil, its impossible for oil not to be in the air to air while a turbo leaking oil... So my second guess was sense everything was clean but the tubes running from the turbo and air to air, and the tube running from the air intake to the air to air was, some took the tubes off another motor and didn clean them... But now looking back and knowing 2 days ago as i stopped by the house, I pulled the air tubes off again, the air to air had a little bit of oil inside. So since im close to the house as i was heading to my destination in PerryVille, Maryland.. I decided to quit,but while heading thru lexington, ky ( approx. 30-40 miles south of home) western decided to tell me to head back to nashville for truck repairs and to switch out trucks, Contract 30 day warranty breached? Turbo is out and made me sit cus its not covered under international 2 yr warranty and trided to get me stuck with the bill? b4 i left the teminal with trk 11022, i had noticed the air filter tube that runs down to that same turbo, both clamps were lossen, only makes me think someone already knew about it and instead of fixing in, they passed the problem over to another lease driver and hoping the warranty would expire b4 it went out. That totally sounds like a breach of contract to me. I had informed western express thru text Only for proof. That someone needed to come get the truck and trailer, it is under a load and i had decided to quit, I will sit with the load untill another driver comes to pick up to insure load securment. Western is telling me that i need to bring the truck to nashville, tn or they will get me for load abandonment, how is that possible? im still with the truck and had informed truck problems. walking away from the truck and not coming back ever is load abandonment, sitting with the truck waiting for another driver to come along and refuse to work is jus quitting. I Take pictures everyday im there to inform that i am still with the truck and i also have taking pictures of the truck number and trailer number on the same picture, I have taken a picture of the seal and the back of the trailer with the number of the trailer and seal number facing out so a zoom would confirm. So the lease company is tryin to get me for abandonment of truck and trailer, and breach of contract, he can have fun with that contract deal, that was under truck number 1590, that truck's motor is junked, contract voided, i dont have a contract with 11022.. lol, i never signed off on that truck so if anything is changed in that contract from 1590 to 11022.. then foragery charges will be brught up, along with a polygraph for confirmation will be required.. I think a company like that should have the doors closed, I think we should do a gathering together, you will find many ppl talkin bad about western, I know them to be true cus i seen all that was done as they would explain it to be. www.indeed.com, www.manta.com, and other site i cant member.
