Mobile, AL- Fatal, witnesses claim trucker "swerving for miles and head bobbing before crash"

    Exactly we all make mistakes but we are all responsible negligence I do not think this driver will go unpunished not in criminal court or civilian court no charges have been filed yet. "Yet"

    So which is it? Either you're correct and his child was distracting him... or the other witness was right and his head was bobbing for several miles before the crash which would (in my opinion) indicate being fatigued at a minimum or asleep at the wheel? Or is there a 3rd option that we don't know about? Apparently the police investigated and in their judgement no charges were warranted. That doesn't rule out civil liability but since none of us know more than what the news has reported we can't judge this driver any more than the court system can.

    If you have "inside information" feel free to share it, otherwise do us all a favor and stop trying to drag this driver's name around. If there's something law enforcement or the prosecutors missed I'm sure the family of the deceased will be filing a wrongful-death lawsuit against the driver (if they haven't already). If not, then as PackRat put it "tough nuts".

    Who cares what the police think? It's not the call of the police, it's the D.A.'s., who rushed to a conclusion.

    His head was bobbing up and down like his was looking for something that his son dropped, so it was due to both. I'm sure a civil suit will happen, of course the driver has no money though and his company was an LLC.

    If there's no evidence to support a charge, then there's no charge. The DA shouldn't press charges because some people whine louder than others.

    To be fair, "failure to maintain control of vehicle" is a charge that is not hard to make stick in such a situation.

    That's barely a ticket. Cops only write those when someone insists they show up to a fender bender. ;)

    Keep sticking up for the truck driver since you do the same thing as him for a living. If everyone stops and the truck driver doesn't then there is an issue, but if you think rear ending a huge group of stopped cars and killing someone in the process is no big deal, then you need to turn in your cdl.
