He's right, I'm afraid.
The Constitution affords protection from the government. It doesn't afford protection from any private entity to whom disclosure of such things is required by that entity to be in their employ.
That said, Hell will freeze over before I submit to anything of the sort from any company. Enough is too much. The Walmart drivers can have it if that is what they want.
How come everyone isn't driving for Walmart?

As it's been mentioned in this thread and many others, a second phone is all you need to circumvent such an idiotic policy.
There is a thread on here from last year started by a former Wal Mart driver out of Fort Collins that got canned over a text message. -

Walmart was a great job in the 90's and before. Now they are too big for their britches! Back then they had a good rider policy for kids, which was really cool. I know how it used to be. I could never driver for them now.

As for the gentleman who lost his job due to a text while driving........... texting while driving is a FEDERAL no-no. Do you honestly want people driving around with 80k pounds, texting?? I don't care how "professional" you are, that is a huge distraction and causes many accidents. He knew the law, he broke the law on a federal level, and he lost his job. Actually, that is not true. What he may have changed his story to, or started out as, is not the issue. The issue was that he answered the incoming text with a one word text. Be it no, or yes, or ok............ whatever. He did make the 1 word text, and had an accident which allowed Walmart to ask for his records.
Believe it or not, you have to work pretty hard to get fired............ unless you break federal law. -
