Canadian HOS

    So correct me if I'm wrong but its my understanding that the Canadian HOS are as follows:

    Cycle 1: 70hrs/7 days

    -10 hours off duty per day, 8 of which must be consecutive.
    -No driving after 13 hours of on duty time.
    -No driving after 16 hours elapsed time since you went on duty at start of shift/day.

    So here's the scenario: Started today with a fresh 70 at 06:00. Worked until 17:30. During that 11.5 hour period I logged 2 hours off duty for breaks, giving me a total of 9.5 hours on duty for today. Boss needs me on call for tonight but under my interpretation of the HOS, if called out, I need to have the truck back in the yard by 21:00 in order to not be over for the no driving after 13 hours on duty. Either that or wait until 01:30 tomorrow after having 8 hours consecutive off duty time.

    Am I correct in my understanding or am I completely out to lunch?

    Almost correct. Your 16 hour window is from 6am-10pm if you have 2 hours off duty at some point which you did. Those off duty periods cant be in any less than 30 minute intervals FYI. But yes you are correct in assuming you can't begin a full shift until after your 8 hours off which is at 1:30am.

    14 hours on duty total, 13 hours driving max leaves 1 hour on duty so you could technically drive 1 hour after being on duty for 13 hours if you get what I'm saying. Your always working against the 14 hour window and 16 hour window.

    Yep my breaks were two 30 minute and one 60 minute so I'm good there. I was discussing this with my boss and I don't think he's too familiar with the HOS regs because he just told me to come in later tomorrow morning if I got called out. We're mechanics, not truckers, so over the course of a regular day 6am-5:30pm we never have to worry about being over hours. This scenario is a little out of the ordinary for us.

    The eight hours sleeper time can be split, but if it is split the two parts have to add up to 10 hours instead of eight.

    He can't claim sleeper driving a service truck.

    This is not exactly correct. Once you start the day you may ACCUMULATE 13 total hours of driving and 14 hours of on duty time.

    You're correct on the off duty time and the 16 hour shift time.

    In the scenario you posted, your day would end at 22:00.

    Assuming the time from 6:00 to 17:30 was spent on duty not driving, you accumulated 9.5 hours toward the 14 hours you're allowed and burned up 11.5 hours of your shift.

    That leaves you 4.5 hours drive/on duty/shift.

    Another thing I've been butting heads with management on is the resets. Basically I've been told I need 3 days off to reset. I've been telling them I only need to take 1 full day off. Since we run 06:00 to 17:30, 1 full day off equals 36.5 consecutive hours off duty time which should reset the 70 hours right?
