    I am a former employee of Sharp Transit.I was off several days and on my way to the beach with the family,when they called me and asked me to go in for a drug and alcohol test.I told them I would go take it when I got back home from the beach with the family.When I got back they terminated me claiming that I refused a drug test and put that on my dac report with HireRight that I refused a drug test."They did this as if they were ordering lunch or something with no remorse."This is one of the most damaging things you can do to a professional truck driver and his DOT record. The sad part of it is that the terminal managerat the time (Dotson) that turned this report in had a personal vendetta against me because I was on to him about the way the truck maintenance was performed. Subsequently him and the mechanic were terminated for corruption within the company. The sad part of it is that my record with HireRight and DAC that is permanent record has destroyed my livelihood with this drug test refusal on it. Let it be known to the trucking industry that I have never refused a drug test Nor Have I Ever Taken Drugs , or was ever given papers to go have a drug test nor have I Ever received separation papers from Sharp Transit Jefferson Ga. Also something all us truck drivers should realize there is benefits for Sharp Transit when they throw you under the bus like this, they can receive a discount from workman's comp which is to their benefit.

    As soon they inform you about it,you have to go within a few hrs,my last test was in the middle of a home time(new dispatcher fault)normally this things are done when you are available for a load,but safety had no choice but to go ahead with it,since i was notified.Definitely get a lawyer.

    When I'm off-duty, so is my phone off-duty, I don't answer it.......I learned a long time ago to keep my work and family time separate, good luck to you though.....

    I definitely am getting a lawyer to look into this I've not been able to get a job since they posted this refusal on my hireright record

    Just search these forums and you'll see it happens a lot,
    You should have took the drug test, but instead you refused and now have a refusal on your record.

    i always keep a few extra gallons in the truck. so if they call i just tell them to grab a gallon and take it to the lab. last year they tested me so much i started bring all my urine to the office. all drivers should bring all their urine to the safety dept and leave it at the door.

    On the way to the beach with the family, off duty, actually on vacation and then a phone call telling you to get a drug screen. NO WAY! First of all, an employer, legally, does this in a manner completely different than what is described here. Unless you are involved in an accident and even then, a law enforcement person will accompany you to the test. When you report for work, "on duty", you will be told that your name came up for a drug screen and you will be provided transportation and you will accompanied by a "company personnel" to the screening location. This is the proper way. Now I know that in 75% of the cases, this procedure is not adhered to.

    Now if this had happened to me, I would give Paul Taylor a call @ Truckers Justice Center(Phone number removed). There would be a whooping lawsuit lodged against this employer.

    9. Notifying Drivers of Required Testing

    Drivers and supervisors often quote the common urban legend that a driver has an hour or two to show up for a random test once notified. Nothing can be further from the truth. To accommodate the element of surprise (unannounced), the driver must have no inkling he or she has been selected and must "immediately" proceed to the collection site once notified. The employee and collection site take into account reasonable travel time to the facility. Advance notice negates the intention of the rules (to catch drivers engaging in prohibited activity). Drivers given warning of a test may refrain from taking drugs or consuming alcohol or have time to consume drug-masking agents or obtain a substitution. The effects of alcohol may also wear off."

    Why not arm yourself with knowledge. Read the green book as it pertains to your situation. Dispute the report with Hire Right citing the regulations the company ignored, or bent, or whatever.
    Then like many have said, hire an attorney.
