Maybe I'm slow, but how does that particular clause help with employee/contractor status. I don't know the customers payment & credit history, & I didn't issue credit to the customer. I'm not quite sure how that clause makes me more of a contractor.

To Add - How do you go about collecting from the customer when your contract says you can't?

Would you give someone your credit card without knowing them, probably not. So you can understand why some people would get worked up over it. Say you book a load totaling $1,000 in fuel, your company can't collect, you're now out $1,000, plus your time. Would I expect my company to eat it, only if they are making the credit decision alone.

You have no idea how much credit is issued to a specific customer, and you have no idea what shape financially the customer is in. You have no recourse to collect because you signed that away. Maybe Mercer will use the clause maybe they won't, but that's why people are upset.

With thousands of drivers over several decades, how many loads now, approaching the 8 million mark, how many times do you think this has even happened? I'd say never on any load Mercer obtained, small possibility on something from an outside source but in that case you are accepting the risk. I, and others I'm sure, see nothing at all to be concerned about.

That has nothing to do with what I said. I never made a claim of whether people should or shouldn't be concerned. I simply stated that they likely didn't read the first one.

Man some people. Ya don't like the new contract then don't sign it and take your truck some where else. Simple as that. All the #####in and moaning is just pointless jaw flapping.

They are adding new clauses to the contact to keep the irs and lawyers happy. Nothing else.
The other clauses that have been added but no one is mentioning is they no longer require you to use their plate or ifta. You can now get your own if you want. And is the same purpose, clarifying contractor status so that no one can try to sue them to get reclassified as employees. Any one that follows this industry has seen a griwing trend in owner ops trying to get classified as employees.

Nah, you aren't alone. Just those of us that realize it's nothing to be concerned about are much less vocal than those looking for a reason to #####. In the years I've been here mercer has never done anything wrong to me, and the money had always been right, right to the penny. I don't believe for an instant that grey are going to suddenly flip a switch and start screwing me now.

There is so much I want 2 say....but apparently I hurt people's feelings and my posts get edited from time 2 time.

Why argue over something when a company is simply crossing t's & dotting i's. If you don't like then leave Mercer.

Watching grown men cry like little girls is ridiculous. This is exactly why I don't sit in truckstops and talk to drivers.

Yes, they do. But there are signs saying the machines may cause heart attacks, so I won't go near the dangerous things, they should be removed and a chicken wing café installed in their place
