Sealed criminal record. Disclose or Not?

    in missouri its sealed to the public even the court record. however if a government agency has to run it through fingerprinting like fbi for my hazmat it would show a court record but no charge. but i have no disqualifiers for a hazmat. just dont want a carrier to see it if getting a twic or hazmat is disclosed through the company

    Sorry but that's not how it works, anything that is court business is not stripped or sealed because of a judges order, it has to be part of the public record and that's where it can be found, it may be buried but it never goes away. Most investigation services won't dig deep, it is too costly but when a good investigator does, then much of what you think is sealed is not.

    I would disclose it with an explanation on the application. We live in an information world. It is out there, it will be found, sealed or not. Many companies will overlook such things if you are up front about it. If you lie about it, they will drop you like a hot rock. Just my 2 cents

    misdemeanor theft would that disqualigy me for trucking jobs? looking for paid cdl training

    You need to pull the court records and get the final disposition. You need to be sure what the court actually has on record. If you were offered a certain deal, make sure they have it on record; the clerk screws up all the time. If this was a first offense, expunge it. This usually requires filing a separate motion. If any potential employer asks about "have you ever been convicted of a crime," you can legally answer "no," if you have expunged it. But that's not where it ends. You need to pull your HireRight DAC report; they will have an expunged conviction on there because they aren't governed by the same standards as the government. For that, you will file a dispute and notate that the conviction was expunged and is legally non-disclosable. Then they will purge your record. Even if it is expunged on record, you need to make sure the consumer reporting agencies like DAC and the like, have updated their records. The short answer is, if it was expunged, dismissed, and you have verified that the court have done everything to ensure this is dismissed, you can legally answer "no" and this is not to be held against you, in any way.

    Check and see if your name shows up in Missouri Courts anything you have ever done in Missouri WILL show up here if there is a record of it,criminal ,civil, traffic, everything. Use the litigate name search.

    Your best bet would be to tell the truth, the whole truth, and nothing but the truth so help you God.

    This way you do NOT have the stress of having hid any information that can come back to haunt you.

    The only thing that the company can do is to say "NO" to you and not give you the job. At least you will NOT be branded a liar.

    Then again, the trucking company may go ahead and hire you because you were TOTALLY HONEST with them on your job application.

    You can show em the paperwork if they hire a real crafty spendy 3rd party background checker and they dig it up..
    When they do find sealed records, its because someone went to the courthouse and requested the record from the clerk of court..It is SUPPOSED to be gone, erased!! Legally!! But it is not, the system is a joke and it never gets completed at- some- level...Very low paid folk handle these matters after the judge slams the hammer..

    The other thought is, its too petty to worry about...laughable actually

    Every 11th guy has a felony..Youd be surprised how many drivers have had past issues..Ive got tons of felonies, all 15+ years back and further (im fixed now!), and Ive gone to the top tier of the highest paying CDL jobs available...

    Sure, a bunch of places wont want ya, pisson em, you dont want them anyways..My pal was all upset because CR england wanted lifetime background check AND hair sample....I laughed, and schooled him up on where to not go...lol

    Crap man, my felonies are bad too and Ive hauled explosives for the DOD, been in the oilpatch, in mining now, gave LTL 5 years...I made it in,,,surprised still !!!
