When he applies to a job that does use the DAC report, instead of the company verifying employment with past employers they use Hire Right to do so, at which time they get any information the previous company will offer and adds it to the DAC report.

His company will subscribe to hirerite just so they can destroy his DAC if they are angry enough.

Actually, you couldn't probably be more wrong. My father who drove for Fed ex Freight had a control valve go bad on his lead pup, he was pulling doubles. He was going down the road and it locked the trailer brakes up going 65mph and threw him into the shoulder of the interstate and laid him over..nearly killed him. So this was a man who drove over 3 million accident free miles in his life, won several TDC championships and was a true professional...so was the accident his fault?? I think not. Accidents can and do happen..and you sir could be the next one to have an accident..so I would choose your criticism wisely without knowing the facts!!

I've never had anything like this happen to me so how exactly is a driver supposed to get a written report saying that the wreck was caused by mechanical failure? I suppose if you are on record as stating that something broke, then the cops are required to impound the vehicle for inspection? How else can they be sure the owner didn't fix the failure before inspection?

I'm my dad's situation, the vendor who did the recovery of truck and trailers found the cause of the accident when he saw the air valve was not functioning. That was the only thing that helped my dad in his court case.

once he files a claim to the insurance company, and the wrecker was called out to right up that rig, it was a DOT reportable. question comes now, will the owner of the truck keep you or fire you?

then comes the question of if the owner had any work done on the rig, that was due or that you may have written up?

could he use you as a scapegoat? most certainly yes, he could

can you get another job if you are fired?

that's really tough to answer, as each hiring company has thier own rules for such an accident. but i have been a witness to an interview and on the application it asked for accidents, then what type, "upset" was one description so i asked what did that mean? (that was the first time i saw that description)

the interviewer said, "rollover, and we DO NOT hire anyone with that on their record"

i told the interviewer, "glad that don't concern me"

so if you get fired, be prepared to be turned down several times, no matter how this happened, it happened.

a rollover is just no good.

very best of luck to you, i hope your employer does not fire you.
