Depending on the state it is possible to get a DUII if you are in "physical control" of the motor vehicle. Definitions of physical control can vary wildly from being in the vehicle with the keys in your pocket with the immediate ability and or intent to move it, or keys in the ignition and asleep in the back seat or in this case the sleeper. Whatever the case I would defintly fight the citation especially if he was in the sleeper, if he was in the driver seat even though parked with no intention of moving he is toast though.
Bottom line is if you drink you best get a room and stay away from the truck.

Bottom line is, consuming alcoholic beverages, or even HAVING alcoholic beverages in a Big truck IS illegal.
And again I ask, knowing this, WhY take the chance?
Is alcohol THAT important?
If we, as professional drivers, don't attempt to put a stop to drinking and driving, WhO will?
Should we just look the other way and HOPE nothing bad happens?
Or try to put an end to the madness and carnage caused by drinking drivers?
I don't doubt that many, even most drivers, are responsible enough to be sober when driving,
it's that small percentage who WILL drive intoxicated that warrants others to try to prevent it.
If not us, ....... WHO?
