    Yes, I understand that.

    Just seems to me there should be a separate, less severe penalty for someone who is not actually driving under the influence.

    Regardless of what anyone says there is a difference between driving drunk and sleeping it off drunk.

    The penalty should be less severe for someone arrested for DWI if they were not actually driving.

    one thing i find interesting is that companies set their own tolerance levels whereas the motor carrier rules book states that you cannot operate a cmv within 4 hours of consuming alcohol.so you can be fired for drinking 10 hrs.before driving but a dot officer could'nt technically fine you or put you out of service for the same offence.:biggrin_25511:

    Most company's will fire you for drinking within 12 hours comming back to work.
    I have heard some company's are even more strict 24 hours.

    A dot officer can put you out of srvice for looking at him or her the wrong way.
    When dealing with the dot your best bet is keep it short and sweet.
    I had to stop at the port of entry all of the time in Wyoming I took all of my info registration,insurance etc.
    When they asked what you hauling it was just a general classification. IE frozen food

    screw the jerk and any other idiot stupid enough to possess, transport or consume alcahol in a commercial vehicle. Glad he got canned and hope he never is able to drive a big rig again...waaay to may idiots behind the wheel these days as it is.....good riddance...

    Be on duty or drive a commercial motor vehicle while in possessing wine, beer, or distilled spirits.( this does not apply to possession of wine, beer, or distilled spirits which are manifested and transported as part of a shipment)

    you are on duty , whenever you are in a big rig in public...
