Bobtail parking ticket at walmart.. cop lied on ticket

    To the public which is the majority of the people driving around, a truck is a truck. That's the point.

    The OP is just nit picking the situation. The sign was posted in general terms. You were not supposed to be there. You knew you weren't supposed to be there, the property owner knew you weren't supposed to be there, the police officer knew you weren't supposed to be there & the court (judge) will know you weren't supposed to be there. You can nip pick this from now till then, but the bottom line & the truth is, you weren't supposed to be there. The sign was a general, broad statement. It included trucks... yes, CMV's... yes, bobtails. Any reasonable person would know the sign included your vehicle.

    So a Pick Up Truck is the same as a Semi Truck Tractor/ Bobtail?

    BTW, there are Pick Up Trucks/Work Trucks registered in some States as Commercial Vehicles too, depending on GVW.

    According to your theory that a Truck is a Truck, ...........people in Pick Up Trucks aren't allowed to park there either.

    Like I said earlier, the ticket is a BS Money Grab for the Local P.D. as the Signage posted is specific to what type of vehicles aren't allowed, but the Local Government wants to tweak it to what suits them according to the situation at hand.

    Local Government is betting that 95% of OTR Drivers aren't going to spend the time to fight it and rather pay the ticket and be done, but sometimes things are more about principal then just paying the fine and forgetting about it.

    25 pages and he still never told us the cost of the ticket. Good lord.

    Let me share a story with you. I got a ticket in Indiana 2 years ago for driving in a lane trucks are not permitted to use. The kicker for me was this; I was already in the lane before the restriction began, and the sign said "trucks use right lane" instead of "no trucks left lane" or whatever. I fought the ticket based on these principles, and because I didn't want the moving violation. Sadly, the county wouldn't budge on the charges and I lost. Ended up wasting $500 on a lawyer service, and $150 on the ticket. I wasn't too thrilled, but sometimes you just can't beat the system.

    My point is, fighting this ticket based on your ideology is pointless. Especially since it's not even a moving violation & won't tarnish you record. The sign says you can't park there, but you did anyway despite the warning. When you see a sign that says you can't park there, don't park there. Sorry dude, that's just societal etiquette for ya.

    Fortunately, your ticket probably won't cost you much. Swallow your pride, pay the fine, and move on with your life.

    Depending on the Local Government, fines and fees are sometimes not known until they send the Courtesy Notice in the mail.

    It's only a 13 page post so far.

    Well... I am sorry that I am late to this party!!!

    I think I am going to have to side with the signs not applying to him in this situation... common sense is not at issue here as the signs are actually putting limits on their meanings... the signs do not say "no trucks" they say "no overnight parking for tractor trailer".... OP does not have a trailer and was not there overnight. Location of the signs also come into play... one sign also says that the parking is for the convenience of their customer, which he was.

    Now depending on where this was and where I was heading next, I would probably pay the ticket and move along, OP never said he wasn't going to pay it, just asked what we thought of the situation and if he has an augment in court.

    If it was in my home state, or where we had a yard, I might concider taking a day off, going to court, and enjoy a bit of judicial debate. Ya, might loose and might then cost me more money but it might also get the signs updated to avoid future confusion.

    I park at Walmarts very often... I normally go shopping for a few things to either stock up or just as a thanks for letting me park there.

    I sometimes call but not always and only twice was asked to move, once by a LEO and actually park on the Walmart property, empty lot was not theirs, and once by a security guard type and she asked that I move 30' to the road that goes around the Walmart property as that was ok to park on the street but not the parking lot.... so I moved 30' and went back to bed... LOL

    If it's not a huge inconvenience and ticket is over $100, I would consider going to court and making a polite stand.




    At least I contributed to helping get this thread to beat the right turn thread.... LOL

    A truck is a truck... and we called it either a truck or a pickup truck... words do mean things.

    And a "pickup truck" is normally in the same definition as tractors.... just a different Class of Truck... normally Class 1,2,3 vs Class 8 Tractor.
