its pretty simple in one regard, i have a year in the seat, my options for local work is still pretty limited many local companies require 2-3 years of driving. after i have more driving time, say i do this for a year or two, i might decide that im not going to accept it..... till such a time i will put up with it.

If, again, if your company is being honest in its assessment, then having a talk, with supporting evidence should not be that hard to do. If the slacker pulls the race card, he can't win.
Simply dispatch both of you at the same time, see who comes back first. Repeat test 2 times, then terminate due to valid incompetence.
I think your "race card" explanation is made up. There's more to the story than you think you know. -
