    I used to build and race sportscars. 2nd Creek was near the Denver airport. When they built the place, there were no houses, just the airport. Suddenly they put houses out there and they want to whimper about the noise. The old hen and henpecked association is like every other bully in life...pick fights with people who cant fight back.

    Doesn't sound much different than Santa Fe. Started out as a horse track in the 1800's and transitioned to automobiles in the '20's. Tornado took out the grandstands, and it was rebuilt and renovated in the early '50's. It was a pretty big track in the Chicago area back then...nothing around it, though. Then as the city expanded and suburbs grew, the surrounding area was built up and the uppity new neighbors didn't like the noise. What did you expect when you bought a house next to a race track?

    You're partially correct. The homes built near there did complain, but the spineless scumbags that were City Council for Commerce City were more to blame. The bowed to those people, it also didn't help that there were several dozen racers who supported the changes that these homeowners demanded. I live 5 miles from it, open track days on Saturdays were fun, took the wife's Audi out there several times.

    But, this is also why Denver airport was forced to move, when the original airport was built in the 20's, there wasn't a house within 10 miles. Then they moved closer, wait, you moved close to an airport, those things make noise you know that right.

    The funny thing is, those saying they won't live in an HOA. My streets are in better shape than City and County streets. We have one City street that loops through the middle of our association, the other 15 streets are owned and maintained by the HOA. Every 3 years we chip seal the residential streets, the city street has never been done, every two years, as needed we crack seal the streets, the City does it every 10 yrs, unless the gap is more than 3". Two years ago we rotomilled and repaved 5 streets, we also found that the company that did our streets originally did a horrible job, and that the city inspector who signed off on it never should have, as well the city is now reviewing several jobs the same company did about the same time, the inspector has since retired.

    Our HOA has one trash contractor, hence part of why it took 15 yrs before we had to serious work on our streets. The opposite side of that, the development down the road from us, no hoa, 500 houses, has 6 different trash contractors coming through, different days of the week, that's a lot of weight rolling on thin residential streets. The City patches those 30 streets as the pot holes appear, so it looks like a patchwork quilt, they have no plans to repave all the streets.

    In 2005, my HOA went to bat for all 300 homeowners when our roofs began to fail because of a construction defect, something they didn't have to do. They could have let all 300 homeowners swing in the wind, and pay for $6,000 roofs on 6 yr old houses individually, instead, they sued the builder as a class action and each homeowner only had to pickup 50% of the cost of the roofs in the settlement.

    The biggest thing with HOA's, you get out of it what you put into it. This is also where the problem is, most people are too stupid to read the documents they are provided, and therefore get into trouble. The items posted about people screwing with their HOA's, sounds like weak HOA's to me, or a weak legal system. In each of those situations presented, I'd have no problem enforcing my Covenants on the resident, and taking them to court if needed. If they want to go to court, so be it, I have deep pockets, if I prevail, not only will you be fixing the issue, but you'll be paying my legal bills (we took one resident to court over a shed that was not approved, and never received a city building permit for. Not only did he loose in court, but ended up selling his home cover $30,000 in legal bills, yet, had he taken 30 minutes to fill out two pieces of paper, he never would have had the problem). Also, HOA's run like little concentration camps are horrible, we've always operated on the philosophy of treating others as we want to be treated. I treat my residents fairly and equally, they almost all know where my home is, and it's not uncommon to have a resident knocking on my door when there is an issue. The only time I treat a resident like crap, is when they treat me like it. If they come to me with a problem, I make an effort to help them, if they don't understand why they got a violation, I try to help them find the problem so they can fix it. When we have residents with problems paying dues, before it gets to the point that they will be turned over to the Lawyer, I make an effort to talk to them and try and work something out. Sometimes it happens, sometimes it doesn't. I've had residents pull a gun on me, I've had them cuss me out or our property manager. Those are people I enjoy turning over to the attorney, those are the cases I enjoy going to court on.

    Also, during the recession, houses in HOA's typically resold faster than in areas without, as well, they were in better shape. At one point, we had 17 empty homes, all in foreclosure, and in each case, we went after the bank to maintain the property rather than let it go to hell. The lawns were mowed, they were watered, the sidewalks shoveled. 7 of the houses were Wells Fargo properties, Wells Fargo used one law firm to handle all these cases, we gave them a choice, maintain the properties or we will, and we'll bill you double the amount.

    Being part of an HOA doesn't necessarily equate to better roads.

    The roads in that neighborhood are atrocious, but there's this old lady who walks around with a yardstick measuring how far from the curb people park.

    So a guy built a shed without a permit. A shed you said would be fine had he filled out those 2 little pieces of paper. And you are bragging about pushing him into debt so far he had to sell his house. over a 25 dollar permit.

    What a sad little man you are. So which is it? Are you short in statute? 5 foot 2? Or do you have a tiny pecker? Its one or the other. Guaranteed.

    Guy fought the law and the law won. He didn't have to fight. I imagine the guy was a miserable prick to take it so far.
