Ruan Lawsuit

I appreciate your comments and will answer a few details that show the injustice of our system and the unethical power corporations have over us. My case went to Federal Court and was motioned successfully to arbitration by the defense. The EEOC did an investigation and tried to settle the dispute. The investigator Reported that Ruan' s reason to terminate me was not Legitimate and could not be supported. A violation of 40;...has occurred. When I turn down a small settlement to walk away and keep quiet my attorney dismissed my case without prejudice, which allowed me to refile my case in federal court. I did not know my attorney dismissed my case until I received a letter from him several days later. Then we went to arbitration where Ruan presented a signed document and a Witness ( former dispatcher) that claimed I acted aggressively towards him in a private meeting. This alleged private meeting was Witnessed by another Ruan driver. The driver later
testified in the hearing that he never signed any such document or witnessed any such meeting. The arbitrator acknowledged Ruan's Witness had lied, but parts of his story was truthful?? Ruan won the decesion. And we wonder why the unsafe working conditions continued during my 5 years with the company. Arbitration is a process used by the Union who did Nothing about the circumstances and the reason I resigned from the Union. The union was well aware of the unsafe working conditions and discrimination against employees who report the circumstances. My case went to the administrative law judge because of my claims of food contamination. I have more than a hundred pictures of these violations that were shown to OSHA but did nothing because I did not work for Kroger. The ALJ judge ruled in favor of the defense that claimed my complaints were untimely. I appealed the judge's decision and now my case is before the review board of the AL J.

I understand. The way truck driver's respond to their bosses abuse is a major factor why this injustice and abuse continues. This forum was a good example. Drivers were actually critical of me for standing up to the Union, est. This is how naive drivers are, and why they are taken advantage of. If you saw the photographs and other evidence I have, you would be appalled. There is a big difference in employment law in California and Virginia. However, "the laws of safety should still apply here." This is why I have fought so hard and long for justice.

 

That would be correct. He was lazy and takes cases for a quick settlement. He stated in a memo to the defence..."We are 100% going to court" and the dismissed my case.
