Nice try. But repair and maintenance is under the on duty despite your run on sentence.
Reread number 6 and number 8. Both would classify you going to get maintenance materials as on duty.

But hey no one will catch you until an audit. Most L/O lie about their legs when doing business.

 

I’m starting to wonder if you guys are making so much money living inside 395 and loving elds, why the hell are you so concerned with what everyone else is doing?

 

I figure shippers/receivers and the #### companies will abuse drivers under this

 

The 14 hour limit was a stupid idea in the first place. Nobody ever knew what was its purpose. Those who say that they do, do not really know what they're talking about - including inventors. The real effect is that everything is in a rush...for me - no more 1 or 2 hours of power naps....Oh I loved them - did miracles for me, especially, after staffing myself with a nice dinner.
They should do away with it entirely and in its place bring back pre 2004 rule of no more than 15 hours work within 24 hour period. Also allow the old split breaking not only 2-8 but also 3-7, 4-6, 5-5... There it is....my wish list.

 

Because I have to share the road with folks. Same reason the motoring public sticks their nose in the industry.

We see the piles of monster and 5 hour energy at truck stop registers. We see folks passed out on the shoulder over their steering wheel. We see the heinous truck wrecks caused by sleeping drivers.

I watch the dregs that can not maintain focus for 14 hours and some silly nutjob wants to give them three more. Personally I would cut it to 8 hours. Most of you folks seem to have issues with focus after that.

 

Please show me where you can not have your nap now.

yawn me tired me need nappy. Heewwwyll, I dunno how those mega drivers can stay awake for over 3 hours without a 2 hour nap. But they are still steering wheel holders and I’m the real deal. I’m the real deal. I have 460 miles to drive and I’ll drive 45 miles and take my nap and then drive another 45 miles and take another nap.

 

Maybe someday you'll have an actual life. Until then, you can go #### yourself. Ordinarily, even my "long" days are completed in 12 to 12.5 hours, leaving plenty of time to swing through the bank to find out what the problem was with the card without pushing me past the 14th hour. I wasn't anticipating dispatch screwing up and telling the shipper there weren't any trucks heading their way when he knew I was supposed to be reloading there. That chewed up a good bit of time waiting for the loaderman to answer his phone, turn his car around, and head back in to get me loaded. 3+ years I've been loading there and this was the first time that's ever happened. HOW THE #### DO YOU PLAN FOR THAT? And yes, if I can take care of personal business while I'm in the area anyway, I'm going to do it. Makes absolutely NO sense whatsoever to waste time, fuel, and wear & tear on my POV making special trips to take care of the same stuff...not to mention, if YOU discovered a problem with YOUR bank account, how long would YOU wait before you dealt with it? Bank was already closed last night when I became aware of the issue, and I was there to deal with it within 15 minutes of the ban opening this morning. Would you have waited until the weekend, then wasted half the day driving up to the bank? Nearest branch is only 45 minutes from the house, so yes it would take half the day to make a special trip...or do the logical thing and deal with it when I'm passing within a block of a branch anyway. If you claim you'd put off dealing with a problem at your bank until the weekend and then waste half your day on Saturday dealing with something you could've easily taken care of in 30-45 minutes the following morning, you're full of ####....but that really isn't news to anyone around here.

 

Try again, there, bubba. It's called reading comprehension. When dealing with matters of the law, it says what it says. #6 deals specifically with breakdowns and your time waiting for a service truck, wrecker, or repairing the CMV to get back underway. If the truck is parked in my driveway and the only thing "wrong" is that an oil change is approaching due, it isn't broke down and therefore #6 does not apply. #8 deals specifically with providing a service to the motor carrier at the direction of the motor carrier. I'm not. The motor carrier couldn't care less when, where, or even if the oil gets changed in my truck, so long as I am able to pick up and deliver their loads on time. Now if the motor carrier owned the truck, then perhaps #8 would come into play...but they don't. I own a company that owns the truck, and that company is NOT a motor carrier. Therefore ANY work that is performed at the direction of my company does NOT fall under #8, because #8 specifically deals with motor carriers. My company instead falls under #9...work performed for non-motor carriers, but again, words have meanings. It specifically states that compensation has to be made when working for a non-motor carrier. That's why picking up hay bales out at the farm is off-duty, because I never accepted any pay. If they paid me, I'd have to log it as on-duty time. Then there's the whole issue of "am I free to do as I please" during that trip to town. I'm driving my own POV, and not on any time clock. I can stop wherever I choose, browse as long as I like, and take care of non business related items, too, if I so choose. It is the very definition of "off duty"...free to do whatever the #### I want to do.

And one more thing: I'm NOT a L/O...never have been. I own my truck with a clear title, and my name has been on the title since the 1st day I drove it.

 

They can't maintain focus for 14 hours, so you want to FORCE them to do what you say they can't do. ####ING GENIUS!!! What you can't seem to comprehend is that they are sucking down energy drinks trying to follow the silly rule, where if they could stop for a few hours mid-day...stretch their legs, sit down and eat, relax for a bit to regain their focus, they would be SAFER when they got back on the road to finish their shift! Nobody wants to work 17 hours. Nobody is asking to be allowed to work for 17 hours. The point of the proposed break is to allow someone who needs a break the ability to take that break without affecting his ability to complete the same amount of work he currently does by pushing through fatigue.
