I am considering obtaining my CDL and embarking on a second career as an OTR tuck driver. As stated in the subject line, I was convicted of a 1st DUI almost 32 years ago, and a 2nd nearly 14 years ago.

According to the California Commercial Driver Handbook, two convictions for driving under the influence will result in a lifetime ban of commercial driving privileges. However, according to an admissions advisor for a local truck driving school, my 1st DUI was too long ago to result in a lifetime ban. Notwithstanding the potential difficulties in finding employment, before I spend money on training I want to make sure I won't have any problem getting a license. At what point during the application process would I be notified that I had a lifetime ban? I have already paid the fee and taken all of the written tests at DMV, and so far, I have not been told that my privilege has been revoked for life. At what point would I be notified if there was such a ban? Would they have already told me at the time of application, or should I expect some notice in the mail?

    Any input is greatly appreciated!

    Tim

How was the wording in the California code? Is it worded as a CMV driver with two or more convictions or just state driver?

It's just a table showing the suspension periods for major offenses. In the column for 2nd offense DUI it just says "lifetime"

Must be a state law for California because there's plenty of CDL-A drivers with 2 or 3 DUI's.
If California stops you from getting a cdl, then change your domicile to a different state.A few weeks ago a driver posted he was hired after cdl school by some company and he has 3 old DUI's.

BOTH of you are misreading those tables. If you had a CDL during those stops, yes you would be facing a life time ban. Once banned it is a federal ban and you would never get cleared anywhere in the US once the federal clearing house set it. Those tables are for CDL holders.

There should be NO person holding a CDL (A or B) with 2 or more DUI/DWI on their records as CDL holders when offenses happened, regardless of type vehicle driven. Those tables in part 383 are explicit. Once lifetime banned you can get a CDL back if 10 years has passed once you go through a process. After this another violation and you get to sit out on the porch for the rest of your life.

He wasn't a cdl holder when he got the DUI's. He got the DUI's years before attending cdl school.

Pull your head out. His last DUI was 13 or 14 YEARS ago (depending on which number is correct in his story). How long does he have to go before he's not an alcoholic in your book?

The second DUI is a strong giveaway.
