If you've ever been on a jury then you know that this decision is a direct result of the judge and their instructions to the jury.

If it's not ok for a CMV to be on that road in those conditions, then why is it ok for a private vehicle? Heck, even a raw CDL grad is far better trained than most passenger car drivers, who are not trained at all.

As has been pointed out ad nauseum, the student trucker maintained control in dicey conditions even after being rammed by the out of control untrained soccer mom.

Kudos to the steering wheel holder. Well done, driver.

I agree with @STexan that the appeal is going to be an uphill battle. Its a civil case so I think Werner has more leeway to argue facts on appeal then criminal, but I just don't know.

I would love to see a trial transcript, but I have struck out so far.

Because they wanted someone to blame for the hardship of the poor innocent single mother. This case is a perfect example off how the average citizen doesn't care about right and wrong or the rule of law. They feel that corporations are evil entities with deep pockets and they should be punished for no other reason than they had the power to punish them.

And no doubt, it was not hard for them to find disgruntled past Werner Trainee Program students who were eager to put their entire training program, from start to finish, in a bad light.

How does that effect what happened? The person driving the vehicle that lost control seen the Werner truck coming and had a knee-jerk reaction and lost control because of Werner's practices? Did they know the Werner truck could have been somewhere else and it was too much for them to handle and just lost control because the situation was so traumatic?

Feel like the one to bring the suit should have been the Werner driver. Hmm, could the woman be counter-sued by either Werner or the driver?

What happened to all the Werner haters?

What happened to all those who used to say Werner and the other megas and their business practices were ruining the industry and making the roads and truck stops less safe?

The woman left one side of freeway crossed median and struck the truck.

Hopefully this is overturned on appeal.

The woman driving the pickup should be sitting in prison for negligent homicide and multiple counts of reckless endangerment of a child.

Don't get me wrong. I would love to see some of them (Mega carriers that only care about the bottom line) get their genitals gouged out with a spoon. But not this case.
