Werner hit with $90 million dollar verdict

    This sets a dangerous precedent. I thought of this yesterday driving down 85 in the pouring rain, wondering if someone was gonna lose control going north and come through the median. I second guessed my decisions in the past week as far as things I done while on duty or in the sleeper..... I know this isn't the case with Werner in the situation being discussed but makes you think that if your not running your operation to a "T" then 1 little mistake can come back and bite you.....

    Thinking we should start an on-going crowd fund to buy these guys out of the billboards and put up pro-trucking messages and actual facts concerning car v. truck accidents in their place.

    unbelievable. i see several holes in the civilians case on black ice alone. the only blame in this case lies on the jury. the jurors simply lack the sense to see through all the bs and assign fault properly. i feel for the family, no one wants to go through that. however, i do believe there’s a special place for those seeking advantage at the expense of others.

    Did the driver at the wheel hold a valid CDL? Was their medical up to date? Well, then, they have been deemed by the state to be "qualified" to operate a CMV all on their own. The fact that Werner was providing ongoing training doesn't negate the fact that the Werner driver held all of the proper credentials to operate that CMV on his own WITHOUT supervision and in accordance with the regulations governing the industry. The fact that he was in control of his vehicle at the time of the crash AND the crash itself did not even cause him to lose control are clear indicators that he was operating in a safe and controlled manner as required by the regulations. The party which lost control, on the other hand, was the party driving beyond their abilities in weather they knew was coming and should have taken the necessary precautions (such as staying home) knowing they are unskilled and incompetent behind the wheel. Evidence for that include the fact that THEY lost control of THEIR vehicle, left the road, crossed the median, and collided with oncoming traffic.

    The plaintiffs bear 100% of the liability for the wreck, and the chances they will collect even a dime from Werner on appeal are slim to none. Like I said, if I were Werner, as soon as the case was overturned, I'd be dragging them right back into court for damages, downtime, and legal fees resulting from the wreck. I know I'd never see a dime beyond the limits of their insurance, but I'd see to it that their lives going forward would be as miserable as possible for trying to score such a payday over a wreck THEY were 100% at fault in causing.

    Amazing how the tables turn, and how our double standards of this country. If equality is what so many want in our country, than it should stand in every aspect. Due to the size, and weight of CMV's, this is why our industry is so regulated and their is a double standard in many instances, and why the DOT, FMCSA, and Government are so #### persistent upon making our lives unbearable.

    Just will go to show, that if weather conditions are this horrendous. Maybe shutting down highways should be the answer until cleared enough for safe travels by any, and all travelling public. In all my years behind the wheel, in all types of adverse weather conditions. I have seen so many acts of stupidity, ignorance, and just shear dumbfoundedness of the motoring public. Granted is is always a tragedy when a person(s) lives are taken in a senseless accident. This can be avoided if people were not in such a hurry, or popped their head out of their *** before driving.
