Out of service for log book

    They should but they don't.Went through this same thing back in the summer when my son was stopped & inspected 6 miles from my yard. OOS for 10 hours because he had filled his out the same way. Talked to a trooper friend of mine about it & he put me in touch with a Sgt. in Nashville who told me how to do the data q process & it was changed to show a clean inspection with no violations.

    It's funny that everyone hammering the
    Dot cop for being a ####### just glossed
    Right over that minor detail.

    He let him slide for being on a
    Restricted no truck route.
    That's no minor infraction.

    The penalty for that could be
    Ten times worse than that log book.
    You piss them off enough they might
    Just change it around the other way.

    Driver just texted back and said the trooper was technically correct. He didn’t carry the line all the way across. Could have let it slide but guess that was the least of the two being on no truck route.

    That makes sense now.

    Cause even the most hard nosed ones are typically letter of the law on logbooks.

    It's right or it's not, no gray area.

    I will say, I used to keep all 3 of mine extremely neat, and on many occasion, that gets basically a flip through without a hard look.;)

    "Inattention to critical detail" that's a pet peeve of mine. I just don't have a lot of tolerance for those types. He has to know you have to draw a line to indicate the duty status you're documenting across multiple days. Yes. It's ticky tacky if that's all it is (I doubt it) but it's such a simple thing to do. And he can't read a map or use a GPS correctly or read a sign? You'll be back here dealing with more trouble this individual got you and your business into, inside of a week.

    I don't care. Flame me all you want for being too hard on the guy. I just call 'em the way I see 'em

    INFRACTIONS. And don’t let him be placarded. The fines would be so big that it would be listed in the Bible book of Exodus as the 11th Plague.

    Another bonehead move like that, you may want to cut that driver before he sinks the company.

    As TripleSix said, bone head move, bone head driver. Violations can greatly affect your business as well as put you out of business.

    However, this could also consitute as a general form and manner violation 395.8 which only has 3 points attached to the violation. Worth a DataQ.

    I'm curious to know which FMCSR code your driver was hit with? Keep in mind, whatever point's the violation holds is + 2 for each year as it was coded with a OOS. Retrain and coach your drivers that HOS violations can/will be a career killer.

    Trooper is wrong.

    Ive done paper with weeks off straight across one page with dates begin to dates end at times. No problems.

    And if the driver was not employed or off previous beyond 7 days into the last 4 weeks or more. Then there isnt anything to log. Especially if you can prove you hired him 7 or 8 days prior.

    Remenber if that driver did work for any employer for wages prior to working for you last 7 days, he has to bring in logbook with that time and recap. But I seriously doubt that is very common anymore.

    The cop gave him a break. Instead of writing a ticket for being on a restricted route he shut him down for 10. Was there a fine for the book infraction ? If not he got off easy. DONT CALL for a supervisor if he is still on restricted route just have him take it and learn.

    When I was placed OOS by NY state of all places in a random rest area (Against my daily 10/14 from previous evening driving and over driving a few hours from delivery in Albany that morning west without enough sleeper time (They don't know that I had been up 2 days and 3 nights to that point) They issued me a 220 dollar fine payable in 7 days or bench warrant issue. And OOS 10 hours flat.

    And told if I left early I would be hunted as a fugitive.

    Followed by a YUGE sticker bigger than a clipboard smack dab in the square center of the drivers windshield. The badge of shame they call it.

    I paid the fine and moved onwards with the rest of the day which pretty much was wrecked for reloading that afternoon. I got the salt in the morning and headed down south with it the following day.

    That is my one and only experience with OOS. And it was not exactly a walk in the park. Just one tiny detail. They were so excited at a righteous violation of the daily hourly for driving and onduty that they did not take a moment to add up the miles west of Albany and figure the hour and minute I got there to that particular spot. Let's just say that old cummins big cam spent a better part of that trip buried at 110+ which was pretty much all you could get out of it empty.

    The devil you can see versus one hiding in the details. Either way Im done. =)
