OK let's try it this way. Has anyone with and ELD when off duty logged off duty driving, then drove for an hour, then switched back to off duty and it counted that hr you were driving as off duty? I have driven off duty driving after a 10 hr break and it did not start my clock. Tried that once so I would know for sure that worked.

If I remember correctly it was Indiana that was putting drivers out of service for working at home. Yes that went to court and Indiana lost. The point is if those officers taught you were fatigued because you cut your grass, on your time off. What do you think LEO will say when you were suppose to be resting in off duty time you were driving your Commercial Vehicle ? Personal car maybe. Can I be off duty taking my required break and work as a uber driver or at Walmart? Hint The correct answer has only 2 letters NOT 3.

Off duty driven will not start your clock. We are talking about driving PC while you are off duty taking a required 10 hour break. If I understand some people here believe you can go off duty and drive those 10 hours under PC, after the 10 hours you have a clean 11/14 clock a available .I disagree.

Tinytim read number 6 that you posted. If a LEO puts me out of service for ten hours I can not drive that vehicle, unless he told me to get to a safe spot to start my 10 hours out of service. Notice they will put you out of service for 10 hours for a falsified hos violation. 10 hours that they want you to spend in the sleeper or off duty. NOT driving under PC. The same 10 hours you must take to gain your hours back.
Did you know that as a team driver we don't have to spend all 10 hours in the sleeper. But we sure can't drive on PC while on our ten off. -
I just drove from SLC to NYS off duty PC and acquired a 34 hour reset in the process. I drove 15 hours the first day and 12 the second and had a 34 in before I got home on the third day. I never stopped for a full ten hour break but did get a 10 hour break in during my third hour of driving, so no, it will not screw up your 10 hour break.

Dr flush thanks for informing us. Just because you did it and were not stop or question does not make it legal. Do you know the maximum miles you can drive under PC?

It was the evening of the 4th of July... I had a delivery in Lima, OH the next morning. I prefer the Pilot in Beaverdam, OH so I parked there and went off duty, went inside and took a shower. Once I was cleaned up I dropped my trailer in the spot I was parked in (also off duty because I was doing so for personal reasons). I then went to PC and drove to Lima, OH (about 12 miles) to the Olive Garden to have a nice dinner. After dinner I remained on PC to drive back to Beaverdam, OH and backed back under my trailer. I then switched the eld back off of PC and went to sleeper berth. My shower and unhooking took about 1 hour, by time I got backed under my trailer after having PCed to Lima and back another 1 hour and 45 mins had passed. For a total of nearly 3 hours. The eld counted all this time toward my 10 break, and I was able to go on duty for my pre trip a little over 7 hours after having returned from Lima. Both the eld and myself knew what I was doing and logged it correctly, I DID NOT lose any of my 10 hours cause I went to PC in the middle of said 10 hr.
My company is very gracious with us drivers and allows us 200 miles of PC per day... This does not mean we can use all 200 miles every single day, but they allow us to have it for when we do really need it, or if we want to run a few miles down the road for a nice meal every now and again. As long as we don't abuse it or do something stupid with that PC allowance we will be allowed to continue to have more than we would usually need. Therefore our PC time is watched very closely. Our fleet is about 70 to 75 trucks and drivers, of which about 70 percent run between 3500 and 4200 miles every week running from the Rockies to the MidWest and back each week. -

The time driving under personal conveyance must allow the driver adequate time to obtain the required rest in accordance with minimum off-duty periods under 49 CFR 395.3(a)(1) (property-carrying vehicles) or 395.5(a) (passenger-carrying vehicles) before returning to on-duty driving, and the resting location must be the first such location reasonably available To the original poster, yes FMCSA says the personal conveyance has to leave enough time for you to get your proper rest, 10 hours .So yes you must start your 10 over.
