Bare min "on-duty" time and Legal?

    at that point, if a driver completes a report and states the vehicle is safe to operate, and it wasn't and investigation would have to be conducted. Whether or not they can prove driver was negligent or falsifying the report is another story I guess.

    Too many variables. If however an Attorney is looking into this a driver and their carrier might be in some heap deep doodoo. Simple enforcement most likely will be a fine and CSA points assessed to carrier.

    As the operator, you're responsible for the safe operation of the CMV. Period. That's the legal requirement. But what that means to you is a different story. Personally, if my name is on it, I'm checking it out.

    Inspection, Repair, and Maintenance; Driver-Vehicle Inspection Report (DVIR)

    If the driver finds a defect, they must report it. If they do not, no DVIR is required.

    Officially this report is not required as you report. However since almost all carriers (required) these reports because they were part of the paper logs, in essence they were required. I do not know how carriers are doing this with the elog systems. However as others have stated very clearly, why not just inspect the truck?

    It's the only thing Obama did right , was to get rid of the DVIR .
    Only time you have to fill one out is if there is a defect.
    That said, your company can still make you fill one out as company policy.

    The question was "is it required by law?", not "should you do your darn job?" nor "can a company require?".

    Imo, if you don't do a post trip AND a pretrip the next morning then you are setting yourself up for failure.
