How did I miss this? Can now use personal conveyance to leave a shipper loaded

    If you are not loaded, or advancing to a load it is not PC. You example of Maine to Cali is incorrect. You would not be subject to 395, or any other reg, at that point.

    At least the name is accurate.

    I rarely use it when I’m loaded, mainly after I’m empty and they’ve run my clock out. You could use it when loaded though. My recommendation is to make sure you put something in the remarks when you do it. And like others have said, guidance is not regulation. You could get an enforcement official with a chip on their shoulder and even with guidance behind you, they can choose to follow regulation and get you for falsifying your logs.

    Just because you’re not under a load does not mean you are no longer subject to FMCSA HOS rules. 15 minutes is one thing, 15 hours is another. Somewhere in there, there must exist some reasonable limits as long as you are operating under USDOT authority.

    Am I understanding some of you correctly?

    Sometimes the Law has a chilling effect on our freedoms.

    I don't view it as being scared, just cautious. I don't know if you noticed or not but anything worth doing, usually vices, fun things and other adventures have been progressively ground out of legal existence.

    If you choose you can take your truck and trailer unloaded on a sight seeing vacation and drive all over the country. You would not be subject to any of the FMCSR's governing interstate transportation.

    Now if you were to take a load from Maine to California and then take your vacation back to Maine and take another load to California upon your return.......well the fines when you get caught are going to hurt.

    About 3 years ago I took my trusty Blackie from Arizona to Texas to lease on with Triple C.

    Somewhere on I 20 a Texas DPS stopped me.

    "Do you have your log book?"

    I says "Sir, many Internet experts told me I didn't need a log book for this trip. However I spent a $1.78 at the Flying J and bought this one, and kept it, just in case of this very conversation. "

    He has this giant toothy smile then. Looked at the pages, I had one for 7 days off.

    Only looked at that and my license.

    "I'm going to give you a clean Level 2."

    "Yes sir. Thank you."

    Guess we all have to play it the way we see best.
