You can talk to all the lawyers you want, you're going to pay that ticket. The NCHP pays very close attention to trucks through there and add sizable amounts of funding to the state coffers from impatient truckers. The so called accident investigation sites are really just cutouts for them to set and watch for contributors. When snow and ice hit that stretch the left lane is as treacherous as it could possibly be due to the barrier and often stays iced up in spots for long periods. Inexperienced drivers driving gutted automatics are a serious pain in the arse through there, but it's what it is.

The only reasonable places to try to pass in the gorge going west are from the 11 to the tunnel.. (after you clear the rest area), and after you come out of the second tunnel to the state line.
You still take a chance.
If you do it.. accept the risk.
The points are hefty. The last I heard it was like 3 or 4 points. I could be wrong, but you'll soon find out.
