SALEM -- An emergency order Saturday has granted temporary relief from hours-of-service limits on motor carriers traveling through Oregon when carrying perishable items.
The order will be in effect for 72 hours starting at 1:55 p.m. Saturday, Feb. 9, and ending at 1:55 p.m. Tuesday, Feb. 12.
Due to extreme weather, it is necessary to expedite the movement of perishable grocery products in order to provide relief to the public. Weather events have caused a shortage of groceries in the Portland Metro Area and Seattle.
Fred Meyers and QFC officials have indicated products are coming from various locations in Oregon. In order to ensure members of the public have access to groceries at all grocers located in these regions, an emergency as described in Oregon Revised Statute 401.025 exists. This order is intended to prevent the loss of perishable products and expedite the movement of goods for public use an emergency exists.
Under the authority granted in 823.012(g), hours of service the Oregon Department of Transportation may allow drivers responding to the emergency situation relief from hours-of-service regulations.
The order
It is therefore ordered that:
(1) Drivers traveling through Oregon carrying perishable grocery products to be delivered in the areas described above are temporarily relieved from the driver’s out of service regulations found in 49 CFR 390 as adopted through OAR 740-100-0010.
(2) The relief granted in section (1) commenced at 1:55 p.m. on February 9, 2019, and is in effect for 72 hours.
