    Was not prompted on the on line app to detail the convictions so I would have to say no I did not disclose up front but did have a line or 2 within body of resume letter disclosing. I'm in Melbourne Florida - honestly, I can't be picky with preferences and don't mind any of it. I was a prof dirt biker back in my teens and early 20's... pulled trailers and ramps back then, grew up in construction family so can drive just about anything

    That act is not that cut and dry. There are several noted exceptions. From this website!

    In the following limited circumstances, the Act allows employers to request criminal history information before the first interview:

    • If an applicant brings up his or her criminal history during the initial application process, the employer may make a reasonable, limited inquiry regarding only the criminal history that the applicant disclosed;
    • Where the applicant is being considered for a position in law enforcement, corrections, the judiciary, homeland security or emergency management;
    • Where the applicant is being considered for a position where a criminal background check is required by law, rule or regulation;
    • Where the applicant may be legally precluded from holding the position by virtue of his or her criminal background; and
    • Where any law, rule or regulation restricts an employer's ability to engage in specified business activities based on the criminal records of its employees.
    A carrier that does extensive business in Canada can't just hire anybody. Same can be said for a carrier that hazmat or TWIC cards are needed. I also took note of this language that seems to me that before a job is offered the carrier can ask.

    The prohibition on requests for criminal history information covers only the "initial employment application process," which includes both the job application and the first interview of the job applicant. Employers are not prohibited from running a criminal background check on an applicant after the first interview or, as is common practice, after a conditional offer of employment has been extended to the applicant. Under no circumstances can an employer consider a criminal record that has been expunged or erased through executive pardon.

    Bottom line this act like the federal Hippa rules should NEVER be used by someone to hide a disqualifying issue. You will in most cases be discovered.

    I would advise checking out one of the Comcar companies. Good chance they will hire you if you are otherwise good!

    Many applications now as for "arrests, charges and or convictions" Take me for example. I live in a state that has the ole, "assault on a female" still listed. Long story, but I got charged with this, bogus crap, for nothing, and was the one assaulted by the psycho woman, but nonetheless, off I went. $10,000 later in attorney fees and a few court hearing and it was dismissed. Great you think. Nope, still will always show on my record, the arrest. And people see it and I might as well have been convicted. So many people's lives in this country screwed up by the trivial crap. I've never assaulted anything of any kind in my life. Way too passive and laid back a guy for that nonsense. No other record at all. Worked for 25 years in schools and with vulnerable populations and that is now 100% out. Truck driving will be fine, they'll let me in with it, but my point is, even an arrest is viewed the same as convictions in many cases.

    Good idea; submit the applications first, then follow with a phone call. If a company doesn't have an online application, just send a fax or email, then call.

    I don't want to be misunderstood. I hope you can un-(redacted) yourself soon. Honesty compels me to tell you that I would not hire you. NINE tickets? Even if I were self-insured that is going to be a problem. Forget the criminal history. Those suspensions and the continued issues are simply too much for the average carrier to bear. Even Carolina Cargo according to you took a pass. Trucking is an industry that is heavily regulated by the federal and state governments. Then you have what an insurance carrier will allow.I would give working local for a few years some serious thought. Honestly, if Carolina Cargo took a pass you got a serious problem.

    I don't think the felony is the issue its a
    misdemeanor.theirs just to many traffic tickets and any company that has its vehicles insured must list recent traffic violations as it effects their insurance premiums and this is the main reason why most of the larger companies will reject the application if you can find a company that don't insure their vehicles then you'll be fine but that'll be as rare as a blue moon.
