    Apply for a 'pretend' job with a friend being the boss. Get a recording of him giving a job related reference.

    If he says anything beyond, "no I would not hire him back" save the recording and press charges. THATS ILLEGAL in Canada do actually say anything past the above statement and you can sue him for defamation and damages.

    It's only defamation if it isn't true. If he can prove what he said was true, you'll lose...and then he'll have something else to share. Not only that, but your recording may not be legal if the jurisdictions involved require 2-party consent to have the conversation recorded...meaning not only could it be inadmissable, but that he'd have the right to seek damages from you!

    Canada is a single party consent Country. Only one party needs to be aware and consent to a recording, there are stipulations but beyond some basic things it is 100% legal, the only big hoop to jump through is it needs to be transcribed by a legal official.

    Meaning it's 100% legal and I've used it before multiple times, even got people in major #### before.

    I don't offer advice unless I know it's legal and works. Lol

    I had an issue with Costco on a load and they destroyed 2 pallets on my trailer (OJ) I got pissed and raised some ####. The Distribution manager and I had a talk on the phone, he called the broker, and my boss, had us banned and tried to get me fired. I played my boss the recording of him admitting they pulled the skids off safely and then put them on destroyed as a 'professional courtesy' and they could have easily reject the whole load and made my day miserable. He then berated me for 10min on the phone.

    When my boss and the broker heard this, we were paid to restack 2 skids of OJ, and paid to ship them back to the original shipper back in Van City, and when Costco got wind of the recording we were effectively unbanned, and my boss was apologized to immediately for the behavior of the manager.

    My boss and I just laughed, as we both knew he was just trying to puff his job up and got checked by someone who knows how bug companies work.

    At 64 years old I've had one boss, one neighbour, a few dispatchers and a couple terminal managers that gave me similar problems over the years.
    I went through proper channels, police, labour board and etc with little success.

    I don't recommend you adopt my method, but the only sure fire fix in most cases was the threat of me dragging them out to the parking lot for a talk and knocking all their teeth out with a hammer.

    One boss was burned by a employee that was particularly difficult. To this day he does a slow burn wanting to crush something. Or preferably that specific someone.

    I ran into him literally at the door buried in a stack of mental "company-do its" that sometimes hollow out a joyful trip done well. Stacks of papers for mileage. They have delivered to the same customer from the same shipper 50 years, they know #### well how far it is.

    I hear from the boss, "*&^% Another Deafie, I swear they are underfoot. Did you (To a third person) hire this one too?"

    I stopped short, said "Excuse me?" with some steel in it. He puffs up with imagined authority as a yard boss. Then starts expounding on the flaws of deafie truckers. I cut him short, saying WHICH driver? He named so and so. Oh that one. Perfect. I proceeded to explain about the Maryland School for the Deaf from kindergarden all the way through high school combined with a college that offers any degree you care to get if you stayed in it long enough. Then I told him particulars about that so and so who I knew personally from childhood elementry and dorm years long ago. He was shocked I had this person's detail to memory and accused me of somehow breaking into his files. I told him aint so. Then I said you are mad because he likes to deep shift a engine to make it smoke all the time killing your fuel mileage where possible constantly. In a operation like his such a loss in fuel mileage is instantly prosecuted.

    He stood there in shock.

    Then he started biting on me. I told him to save it. Then explained that I am half and half between the deaf world and the hearing world in which I am trying to educate the Boss right this moment in a strong diplomatic manner quickly enough so I don't get fired for a long winded airbag explanation. He asked why am I a trucker then? I tell him that's what I wanted to do ever since a family friend hauled me as cargo in a old antique B model dump truck.

    His eyes glassed over as the old trucks marched across his memory as I detailed that day.

    Whatever issues he had before that day did not matter. Whatever issues he had with me after was quickly solved with a big mouth application on what's known as a one way conversation. Delivered with appropriate profanity if I made a mistake somewhere in my work with them.

    He was not a bad boss. But anyone who has to live this life in this world that tangled up in a web of his own doing is pulling too hard upgrade. If he don't watch it he's going to burn out by 40.

    I had some friends in Employers with a couple of trucking companies here in Arkansas and once in a while they keep me updated on one particular company. They are allowed to use the word blacklisted against me by telephone never in writing. to a employee past history application situation. after the 10th year has passed, they no longer were a concern and two of my employers asked if I got a new spine yet? Would I be interested in running for them? At that time I had discovered the joys of running high value million dollar loads in pharmacy etc. (Ironic, I depend on the darn things to function well enough.) I still have not yet solved the inflammation problem without looking at it being Rheumatoid Arthritis. The harder I work, the easier it is to burn it up.

    Yes, but he'd probably only be eligible for actual damages, assuming he wins. Sounds like the OP hasn't actually had any problems finding work and is just annoyed with the guy. So what actual (as in monetary) damages are there?
