HOS Confusion with local work?

    Just to add to the ag exemption.
    One can actually run 168 hours a week non stop if they don't collapse from a heart attack first.

    Any running the federal ag exemption. Under that exemption there are no HOS.
    I'm talking the 395.1(k) 150 mile federal exemption.

    No, once he crosses 60/70 he’d have to take a 34 off duty before he can drive again, but otherwise he can work in the yard until kingdom come.

    Non-cdl NPR XD and a Hino that I run local (under the 150 rule), or Intrastate only a few interstate, WA and OR to Reno, NV and LA and SD to Las Vegas I'm a company driver.

    Every load I carried for NASA to Mojave that clearly came from the ISS and probably contained some kind of test module had a BOL start of LAAFB El Segundo, CA 90245.So how do they log that under federal regulations? Hmmm. Made in a lab in Silicon Valley, shipped to Mojave, shipped to LAX, flown to Russia, trucked to Kazakhstan flown to space, returned from space to Kazakhstan flown to LAX, shipped from LAX to Mojave? How do the Fed regs handle intergalactic transportation? It's point of pick up, not point of origin for intrastate transportation.

    You obobvious don't want to actually read the links or text of the regulations that have been posted previously, however that still does not make your position correct. The very definition of interstate commerce in 390.5 clearly states orgin and/or destination outside of a state or the country, and transportation from point to point within a state when a part of a shipment to/from out of state or country.

    Believe what you wish, I am done here. One day a sharp DOT officer will catch on and set you as well as your company straight on interstate commerce.

    One last attempt at education, please follow this link and read both the chart and the accompanying guidance. Yes, it's from Oklahoma State Police, not CHP, but the laws are the same since it is about the differences between interstate and intrastate commerce.

    49 CFR 390.5.:
    If you perform trade, traffic, or transportation exclusively in your business’s domicile state, this is considered intrastate commerce....my emphasis on you.
    My picks and drops for NASA and NAS China Lake are in CA

    If your trade, traffic, or transportation is one of the following, this is considered interstate commerce.....my emphasis on your

    1) Between a place in a state and a place outside of such state (including a place outside of the United States)

    My "trade, traffic, or transportation" is entirely within CA for these loads, I do not travel outside of my state for either the pick or drop....my emphasis on my.

    2) Between two places in a state through another state or a place outside of the United States.

    I do not travel through Nevada or Mexico to get to Mojave or Ridgecrest.

    3) Between two places in a state as part of trade, traffic, or transportation originating or terminating outside the state or the United States.

    My loads originate in and terminate in CA. The BOL's clearly state this. What happens before I accept the load and after it's signed for is out of my control.

    My trade is truck driver, it is not space man or scientist...
    My traffic is the route I take to get the job done from point A to point B....it is not the ocean the load crossed to get to me, or a plane it flew on.
    My transportation is the truck i drive...not the ship or plane that got it to me.

    Fact is, if you really want "guidance" on the matter, the stuff was built in Mojave or China Lake, sent to space or off shore for testing, and is being returned for download of test information.
