Anybody witness the fiery crash in Denver involving a trucker?

    Pretty sure the manslaughter charges all stem from him being filmed driving out of control, presumably without brakes, before he passed the escape ramp. Im guessing that without the escape ramp playing into the equation and his decision to not use it, there would not be any charges. I doubt the law would require you to crash the truck to save the stopped 4 wheelers.

    But that statement he made would convict him all by itself, I'd think. He basically admitted that he chose to avoid hitting a truck, so he could hit softer targets instead, and maybe have a better chance live - at the cost of others' lives.

    There are many layers to this onion.

    If he couldn’t read the sign, then what? Are you still guilty if you can’t read the English sign or so darn green you don’t even know what a ramp is?

    I read a legal opinion that held he would be guilty if he failed to notice the brakes were dysfunctional when he did his pre trip

    This is a tough one. Cowardice aside, Are you required by law to kill yourself in that situation?

    That raises an interesting question. Lets say a driver was rolling down the road and was hit by a four wheeler or debris and he ruptured a fuel tank. That fuel then sprayed onto his brakes rendering them basically useless. He comes around a curve on a slight downhill only to see traffic has come to a stop. Is that driver legally required to hit the back of a parked semi to avoid the inevitable death of others?

    No, I am confident that civilian law never requires you to die to save someone else, but he also said he closed his eyes. Which meant he gave up control of the vehicle while it was still rolling.

    The persecution lawyer is going to wreck his defense, even if it is found that his truck suffered some sort of catastrophic failure that he isn't responsible for.
