I think his best defense is that he was woefully ignorant and way to inexperienced and under trained to be placed in that situation and that he felt pressure to do what he was told for fear of losing his green card. All of which would likely be true

I just did a search, the FMCSA requires the test be in English, but there appeared to be all kinds of study guides and practice tests in Spanish, I expect the understanding English to be enforced better, seems it was relaxed several years back.
On another note, I lived near a bad wreck on a secondary hwy over 20 years ago, that driver was from India out of Stockton, California, and he was said to speak English well by his company, but he forgot how during the excitement.
Steep hill, narrow bridge, wide farm equipment, no one got killed, but everyone was lucky that day. 6 month old Pete totalled out, frame rails twisted badly and other damage to components. This has me wondering. When people post about what to do when they get a ticket, the typical advice is to fight it even if they're guilty. Is there much difference between that and forgetting how to speak English?
