You can use the yard move exemption. The regulation says at 5 mph but the companies are free to make it as sensitive as they choose. I won't say the company name but I had the ELD in one truck record a "critical deceleration event" when I had been parked and off duty for an hour because I stepped on the brake getting out to go eat dinner. -
Yard Moves simply means you are on duty but can move the vehicle without being placed on line 3. There is no way to alter the 5mph threshold.
The 'critical deceleration event' that your truck recorded was a feature of the tracking system, not the ELD itself (behavioral monitoring is not part of the FMCSA ELD mandate). The fleet tracking solution I use will alert on things like that as well, but it has nothing to do with the ELD portion of the system.Dieselboss Thanks this. -
The ELD additions to the regulations add a yard move option to the ELD, but the definition of Driving still states all time at the control of a cmv.
There is even guidance that states it should be Driving.
Now will it ever be an issue? No, but it is one of those bureaucratic mess up that make following the law hard to impossible.gentleroger, stwik and CousinVinny Thank this. -
FMCSA states in their FAQ:
Q: What are the options for electronic logging devices (ELDs) to electronically transfer data?
A: To ensure that law enforcement is always able to receive the hours of service (HOS) data during a roadside inspection, a driver must be able to provide either the display or a printout when an authorized safety official requests a physical display of the information.
Meanwhile, §395.24(d) states (without exception):

There are supposed to be new HOS proposals published buy the FMCSA. This was supposed to be on June 6th bit now Ray Martinez stated this week it has been delayed....Once they are published there will be a listening period for drivers to sign into the FMCSA website and give feedback. Proposed changes could be removing the 30 minute break and adjusting or eliminating the 14 hour clock...My contacts in DC are going to post it as soon as FMCSA does..

Now if my 14 runs out at reciever or shipper i can go to special conditions and log forced to leave shipper or reciever to a TStop or nearest parking. PC isn't regulated by the Govt. My carriers sets it at 90min. Refreshes at midnight
New Elds Safety will no longer be able to alter or correct any drivetime. Currently they can and carriers have abused it. -
