    A class action against Swift for causing everyone to lose their CDLs has already been filed in federal court in Memphis, TN.

    I would start by contacting the attorney listed in the article. They'll put you on the list along with everyone else. If it's like my husband's case was, they'll contact you sooner or later. Since the attorney is listed in the article however, I would go ahead and contact him.

    I sent an e-mail yesterday. No reply as of yet, but I imagine they're just inundated.

    Well, maby it is just me, but why a lawsuit against Swift? As far as I know SWIFT is NOT the one who is forcing you to do your CDL again, ok they might have made a mistake, but nobody complaint back then about the fact that you guys had it pretty easy to get your licens
    And if you would have stayed at SWIFT for two years you wouldn't have paid anything at all for your licens.

    No, Swift is not the one forcing us to re-do our CDL, it is at the discretion of our home states whether or not to act on the notification given them by TN. However, that does not relieve Swift of responsibility. Yes, there is plenty of blame to go around, and obviously TN was not policing their own system. But, it was not the state of TN that promised us a service that cost $3,900 which was not received. It was Swift and it was their school's job to be testing us properly and legally, and if they did not have that capability to do so to send us to the proper testing facilities. At the same time it was TN's job to check up on third party testers to make sure they were following the law. I would say part of the argument here that is causing many to seek a lawsuit is the fact that a service was paid for that was not obtained. An expensive service. Whether people stayed with Swift for the two years or not doesn't even matter--that is still a form of payment. If someone signs a contract with a school stating that if they pay such and such and meet all requirements they will recieve a valid license, then a valid license is what they should receive and what the school is contractually obligated to provide. Just because this happened years after the fact for many people doesn't make this statement any less true. If you go to college and spend years and money on a degree, you expect a valid degree that can be used to procure employment or entrance into a higher school. Would not a college be held responsible if years later they invalidated thousands of people's degrees because they found out a specific teacher was questionable and operating illegally? I don't see how this is any different. Many will say it is because it was "just a trucking school" and it's just a "driver's license," but if you ask me all people are entitled to receive what they pay for even if it's not the biggest or grandest thing in the world. My long-winded point is this: Swift made a mistake. In the real world mistakes can be costly to the one who makes them whether they made them on purpose or accidentally. Everyone who is a driver should understand this, it is drilled into our heads daily in the trucking profession. We all know what can happen when we make an honest mistake in our log books or make an honest mistake while maneuvering in traffic. There are real life consequences to bear for such things even if no one intended to make the mistake. Maybe Swift did not mean for anything like this to happen. But it did happen, and they should be held liable for their negligence as any driver would who makes a mistake on the road. There are people who have lost their jobs because they cannot afford to re-test. There are people who have gotten into legal trouble because they did not know their license was cancelled or suspended. It is easy for those who were not hurt by this to judge the actions of others. It is not their wallet or livelihood being affected. It is not them who have to start all over because circumstances caused this to surface at the worst possible time.
