I would like to know if anyone has been through a similar experience that can help me out with this issue. I was loaded with a mixed load of carrots and broccoli from Hidalgo, Texas going to Georgia and North Carolina. I was not allowed to be on deck to check the product. When I arrived at the first stop, they unloaded some of broccoli pallets and noted on the BOL "received under protest" due to poor quality of broccoli. On the second drop, the receiver refused to unload the truck until an inspector came. So, I waited an entire day for the inspector from USDA to come and check the product. The inspector said the product was not good after only looking a 3 boxes, so the receiver rejected the load. The broker stated that they were going to talk to their client, but could not solve anything that day. The next day the broker sent me to another place where they were suppose to unload all of the pallets, when I arrived they unloaded only the pallets of carrots and rejected the broccoli because its in very bad condition. The weekend came and broker could not solve anything with the client and I spent the entire weekend stranded in NC with a bad load of broccoli. On Monday morning they sent me to another place saying they were going to unload the pallets there. At this point, I just wanted them to unload the bad product from my reefer, so I can get moving, so I went ahead and drove 200 miles to deliver the pallets to the other place. So, I get there and they look at the product and same story, they don't want it because its bad. I've been waiting for 6 hours for the broker to figure out with his client how to get rid of the product, and I don't know what to do. I just want my reefer back. I'm losing money by the minute.
I called my insurance agent to see if he could guide me in what to do. I just want to dump the broccoli somewhere and get my reefer clean, but he said to wait because they might want to bill us the entire load of broccoli like it was good. So, I don't know what to do. How much time should I wait? It's already has been almost 3 days that I had the broccoli in my truck attempting to deliver at 3 different locations that have all rejected the product and broker keeps telling me they are trying to figure out with client what to do. I appreciate any advise on this issue.
