Notice of being sued

    I was involved in an accident last year (November) and was just served with a notice that I was being sued? The 4 wheeler left the scene for one, I was not ticketed for 2 and 3 why almost a year later am i receiving this? Any advice would be greatly appreciated. T.I.A

    First, lawyer up.

    Second, are you a company driver, or an owner operator? Either way, lawyer up. Don't rely on your insurance company lawyers or your company's lawyers (if you are a company driver) to protect YOUR interests.

    Third, did you call the police and get a police report? This is essential.

    Lepton1 I am a company driver, apologies, and will be doing that first thing tomorrow morning, it's 2118 here in San Antone. She tried beating traffic man to be honest she sped up and slammed into my passenger side steer/bumper.

    Talk to your insurance company and let them know of this notice. You may not need a lawyer. In every wreck I've been in they handle it all. I'm pretty sure I've gotten scary mail like that too.

    That is wierd, did you report the accident. You would thing she would be going after the company, which would mean their insurance. I would have a lawyer send them notice you are filing a counter suit.

    I got one like that one time. I was a company driver, so I gave it to the company and let them deal with it.

    Probably the runaway driver's attorney is going after all entities. This means going after both the company and the driver.

    There is more to this story.
    How does she know who you are?
    Did you pull over and exchange information?
    Did you report the accident to your company?
    Called the police and get a report?
    Your company was most likely served also.
    Look on the summons are they also named as defendant or is only you?
    If she filed a lawsuit against you and not your company she hired the dumbest lawyer on earth.
    So many unknowns here. Your company’s insurance should take care of this.

    Unknowns? The accident occurred I called it in she left. Nothing more to know or say.
