Drug and alcohol consortium info

    I got pulled at a scale house in Tenneessee last Feb and was told that I needed a cdl, medical card and a log book. They also said I needed to belong to a Alcohol and Drug consortium. I was driving a Ram 3500 and pulling a 36' gooseneck cargo trailer coming back from a horse expo in Murfreesboro where we had set up a booth. I have pulled gooseneck horse trsilers and cargo trailers for over 40 years and was totally unaware of these requirements. I have my truck registered for 26,000 lbs to cover the weight of my truck,trailer and contents as told to me by the Virginia dot a few years ago. We seldom go over 21,000 lbs but I got extra just to cover my butt. They didn't give me a ticket that day, but last month Fmcsa sent me letter charging me a civil penalty of $3290. For not having a cdl & $8680. For not belonging to a Alcohol & Drug consortium. I got a clean driving record and this is my first time I've ever known about this.I'm open for any suggestions.

    I think you registered the weight of your rig wrong is the problem, but I'm no lawyer.

    You should have registered it under 26000, then the requirements go away.

    I thought the requirments only started at 26,001?

    I agree with Chinatown, you need a lawyer.

    What is the GVWR of your Ram, and what is your GVWR of your Trailer. That is the first thing you need. Your lawyer may be able to do something if the combined GVWR of the two is below 26,000 lbs.

    Were you hauling the cargo trailer as part of a business or for other people and getting paid for it?

    The truck is 14,000 lbs and the trailer is 17,000

    By your last two responses, combined GVWR, and using it for your business. You are required to have a CDL and Medical Card. All the other requirements to operate a commercial vehicle. The government slowly bringing companies into this classification.

    You can also ask the FMCSA for a reduced charge of your fines. I know a Carrier that had 45k in fines after an audit that were reduced to 15k.
    Get compliant asap and give them a call.

    Lawyers aren’t cheap these days..
