Swift Academy Licenses Suspended

    ouch!!!!! my question mr vanell is if you were a nures in germany makeing good bucks as a rn and the u.s. is dying for qualified nures at 30-40 bucks an hour and 4 day 16 hr work scheduals plus 2000 sign on bounsus hmmmmmmm why are you driveing a truck!!!!!!! and yes my rates for a rn nurse are correct,my siter-in -law is a prenatel nurse at tampa general and she makes way more than us drivers?????and shes home everynight????? just wondering!!!!!??????

    Look at this thread. Truckers using terms like "due diligence" and "something of faith". I'm no lawyer but those are legal terms we would not understand any more than a lawyer would know about air pressure. Let's get a grip on this.

    I'm going to be VERY unhappy if this thread gets shut down due to some readers' recent comments! I've worked very, very hard over the past six months to find what I could regarding the Swift PDA - Millington fiasco and post it on the web as reliable source of information.

    To that end (though I've not mentioned this before), I've referenced this very thread to members of the news media and local legislators, among others - to illustrate that not only are we drivers serious about righting a wrong - but also to show that we're not just a big bunch of dumb truck drivers! (Imagine how we're going to appear to your congressman if he decides one day to "read up" on this topic - only to find bickering instead!)

    My main request from posters from day one has been to post useful items as they relate to this topic - for fear of the thread someday degrading into something totally different, or at worst, a fightfest.

    PLEASE, everybody, let's move on from the recent squabbling - I know we have differences of opinion - but continuing to argue over them isn't going to help the affected class of drivers that I am truly trying to help.

    Please also know that I value each and every one of your comments - as it's through your help and persistence that this little, humble thread has over 12,000 page views! (Check the thread listings - very few get into the range of tens of thousands!) I just don't want the thread to become a place where we lose sight of what's important and get shut down as a result.

    IN OTHER NEWS . . .

    I contacted the law firm of Philip Stephen Fuoco (Haddonfield, NJ) today (reference http://www.thetruckersreport.com/tr...academy-licenses-suspended-21.html#post939090 ). Left them my contact info, and reiterated my point that all affected drivers need to be provided (at no charge) a tractor-trailer and accompanying, fully-credentialed driver for a road test.

    "Sheryl", whom I spoke with, assured me that although they are only in the preliminary stages of pre-trial work, that my concerns will be heard and that there is much, much more to come.

    "sound_man," I really didn't think that posts on this thread were overly technical. I've tried my best to explain things in a simple, easy-to-understand way, and so have, I think, nearly all the other members who've posted here. Maybe the problem lies in that this is a legal issue, so oftentimes legal terms lend themselves to the discussion well.

    That being said, if I can explain something better, feel free to post or PM me (if you have privileges to do so), and I'll try my best to "speak to the masses".

    I, for one, also apologize for my actions and words. I can only say that finding out that my money, time, energy, and all that time I spent on the road was all for nothing, and my nerves are still raw from it all. I feel betrayed, I feel like the State of Tennessee wronged a lot of us by the cart blanche cancelling of our driving privleges. From the descriptions that one or two of the replies about how their "testing" was performed, I didn't see that when I took my tests. My whole class was tested over several days. We took on the different skills, with someone who had nothing at all to do with our training as the person who graded our performances. When it was time for the road test, I was tested by a person who was not my instructor. So, I for one, don't know where the "alleged" "improprieties" that Tennessee was talking about.

    If it was one or two classes, I could kinda see that, but to invalidate licenses for a 3 year period, with a total of 5000 drivers nationwide, without contacting them at the time this was being considered, its just insane. If the state of TN had contacted me stating that there was a chance that my license was about to be suspended due to these problems, at the time when the academy was raided(the day it happened, I was actually still a swift employee and was so till the end of Feb) I might have gone to my state DOT and asked to be retested. If they had done this even in January of this year, I was working for a different employer at that time, and still had access to a truck. I realize its not my state's fault, nor the state of Tn's fault that I left my job when I did, but, if they had at least hinted at the possibility of this, I would probably have made plans to retest long before now.

    I would like to suggest this, maybe Swift can offer for us to come back to the academy, so that we can spend some time practicing these skills to prepare us for a retest, then send us to our respective states with a mentor to retest. Then they can then reoffer us jobs, at the payrate for someone with our experience levels, or give us a "sign on bonus" as part of the punitive damage repayment, then cut us loose. I mean, they would still get the government money for retraining that they make us all sign papers about all over again, so its not really a no win situation for them.

    To be honest, if Swift would pay me the 34 cpm I was getting with KLLM, I would probably do it, and I would consider my problems with swift taken care of.

    But thats all just off the top of my head.
    Once again, sorry that I got worked up, but it just annoys me that the license I intended to keep, I cant keep now...

    "sethw77," it may come as comfort (though, maybe not) for you to know what at least one of the class-action lawsuits against Swift is trying to claim.

    The law firm in New Jersey that I spoke with Monday is stating in their suit, essentially that:

    1) Tennessee and TDoS had no right to essentially invalidate licenses issued in their state once they'd been issued - basically saying that the responsibility is/was upon them, at the time of issuance, to ensure all procedures have/had been followed, etc. Once the license is issued, they can't just "take it back" at a later date because test scores, and the licenses that they enable to be obtained, become property of the license holder, and can't be removed without "due process" (some sort of hearing, at the very least).

    2) All the other states, then, which subsequently invalidated licenses based upon Tennessee's actions, also deprived their commercial license holders of due process since again, no hearings have/had been held prior to removing those drivers' commercial privileges.

    3) Swift knew, or should have known, that their testing and licensing procedures were improper and/or inadequate, and continued to run the Academy as a means to profit at the expense of their students. As a result, continuing to run the Academy, test and license students, collect monies and pursue collection practices for delinquent accounts is/was fraudulent.

    Yes, it's written by lawyers, but I think most of us will be able to get a general idea of what's being said in it.

    Contact info is included at the bottom of the file. Since "Sheryl" who answered the phone took my contact info, I think it wouldn't hurt for other affected drivers in the "class" to contact them as well.
